5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to requiring public schools to provide instruction and
68 materials and adopt policies relating to the prevention of child
79 abuse, family violence, and dating violence.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9- SECTION 1. This Act may be cited as the Christine Blubaugh

1113 SECTION 2. Section 28.002, Education Code, is amended by
1214 adding Subsection (u) to read as follows:
13- (u) The State Board of Education shall adopt rules requiring
14- students to receive instruction on the prevention of child abuse,
15- family violence, and dating violence at least once in middle or
16- junior high school and at least twice in high school. The
17- instruction must include information on:
15+ (u) As part of the essential knowledge and skills for the
16+ health curriculum under Subsection (a)(2)(B), the State Board of
17+ Education shall adopt rules requiring students to receive
18+ instruction on the prevention of child abuse, family violence, and
19+ dating violence at least once in middle or junior high school and at
20+ least twice in high school. The instruction must include
21+ information on:
1822 (1) the dating violence policy adopted by the
1923 student's school district under Section 37.0831;
2024 (2) the prevalence of dating violence and the
2125 recognition of abuse warning signs;
2226 (3) the procedures for reporting violence or abuse;
2327 and
2428 (4) educational materials or resources available to
2529 students under Section 37.0831(c).
2630 SECTION 3. The heading to Section 37.0831, Education Code,
2731 is amended to read as follows:
2832 Sec. 37.0831. DATING VIOLENCE POLICIES; EDUCATIONAL
2933 MATERIALS AND RESOURCES.
3034 SECTION 4. Section 37.0831, Education Code, is amended by
3135 amending Subsection (b) and adding Subsection (c) to read as
3236 follows:
3337 (b) A dating violence policy must:
3438 (1) include:
3539 (A) a definition of dating violence that includes
3640 the intentional use of physical, sexual, verbal, or emotional abuse
3741 by a person to harm, threaten, intimidate, or control another
3842 person in a dating relationship, as defined by Section 71.0021,
3943 Family Code;
4044 (B) a clear statement that dating violence is not
4145 tolerated at school;
4246 (C) reporting procedures and guidelines for
4347 students who are victims of dating violence; and
44- (D) information regarding the instruction on the
45- prevention of dating violence required under Section 28.002(u); and
48+ (D) information regarding the essential
49+ knowledge and skills relating to dating violence required under
50+ Section 28.002(u); and
4651 (2) address safety planning, enforcement of
4752 protective orders, school-based alternatives to protective orders,
4853 training for teachers and administrators, counseling for affected
4954 students, and awareness education for students and parents.
5055 (c) To the extent possible, a school district shall make
5156 available to students:
5257 (1) age-appropriate educational materials that
5358 include information on the dangers of dating violence; and
5459 (2) resources to students seeking help.
5560 SECTION 5. This Act applies beginning with the 2021-2022
5661 school year.
5762 SECTION 6. This Act takes effect immediately if it receives
5863 a vote of two-thirds of all the members elected to each house, as
5964 provided by Section 39, Article III, Texas Constitution. If this
6065 Act does not receive the vote necessary for immediate effect, this
6166 Act takes effect September 1, 2021.
