4	6		AN ACT
5	7		relating to requiring public schools to provide instruction and
6	8		materials and adopt policies relating to the prevention of child
7	9		abuse, family violence, and dating violence.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9		-	SECTION 1. This Act may be cited as the ~~Christine~~ Blubaugh

11	13		SECTION 2. Section 28.002, Education Code, is amended by
12	14		adding Subsection (u) to read as follows:
13		-	(u) The State Board of Education shall adopt rules requiring
14		-	students to receive instruction on the prevention of child abuse,
15		-	family violence, and dating violence at least once in middle or
16		-	junior high school and at least twice in high school. The
17		-	instruction must include information on:
	15	+	(u) As part of the essential knowledge and skills for the
	16	+	health curriculum under Subsection (a)(2)(B), the State Board of
	17	+	Education shall adopt rules requiring students to receive
	18	+	instruction on the prevention of child abuse, family violence, and
	19	+	dating violence at least once in middle or junior high school and at
	20	+	least twice in high school. The instruction must include
	21	+	information on:
18	22		(1) the dating violence policy adopted by the
19	23		student's school district under Section 37.0831;
20	24		(2) the prevalence of dating violence and the
21	25		recognition of abuse warning signs;
22	26		(3) the procedures for reporting violence or abuse;
23	27		and
24	28		(4) educational materials or resources available to
25	29		students under Section 37.0831(c).
26	30		SECTION 3. The heading to Section 37.0831, Education Code,
27	31		is amended to read as follows:
28	32		Sec. 37.0831. DATING VIOLENCE POLICIES; EDUCATIONAL
29	33		MATERIALS AND RESOURCES.
30	34		SECTION 4. Section 37.0831, Education Code, is amended by
31	35		amending Subsection (b) and adding Subsection (c) to read as
32	36		follows:
33	37		(b) A dating violence policy must:
34	38		(1) include:
35	39		(A) a definition of dating violence that includes
36	40		the intentional use of physical, sexual, verbal, or emotional abuse
37	41		by a person to harm, threaten, intimidate, or control another
38	42		person in a dating relationship, as defined by Section 71.0021,
39	43		Family Code;
40	44		(B) a clear statement that dating violence is not
41	45		tolerated at school;
42	46		(C) reporting procedures and guidelines for
43	47		students who are victims of dating violence; and
44		-	(D) information regarding the instruction on the
45		-	prevention of dating violence required under Section 28.002(u); and
	48	+	(D) information regarding the essential
	49	+	knowledge and skills relating to dating violence required under
	50	+	Section 28.002(u); and
46	51		(2) address safety planning, enforcement of
47	52		protective orders, school-based alternatives to protective orders,
48	53		training for teachers and administrators, counseling for affected
49	54		students, and awareness education for students and parents.
50	55		(c) To the extent possible, a school district shall make
51	56		available to students:
52	57		(1) age-appropriate educational materials that
53	58		include information on the dangers of dating violence; and
54	59		(2) resources to students seeking help.
55	60		SECTION 5. This Act applies beginning with the 2021-2022
56	61		school year.
57	62		SECTION 6. This Act takes effect immediately if it receives
58	63		a vote of two-thirds of all the members elected to each house, as
59	64		provided by Section 39, Article III, Texas Constitution. If this
60	65		Act does not receive the vote necessary for immediate effect, this
61	66		Act takes effect September 1, 2021.
