54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to verification of the citizenship status of certain
87 registered voters.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 16.0332, Election Code, is amended by
1110 amending Subsection (a) and adding Subsections (a-1), (d), and (e)
1211 to read as follows:
1312 (a) After the registrar receives notification [a list]
1413 under Subsection (a-1) of this section, Section 18.068 of this
1514 code, or Section 62.113, Government Code, of persons excused or
1615 disqualified from jury service because of citizenship status or
1716 notification of persons who have indicated a lack of citizenship
1817 status in connection with a motor vehicle or Department of Public
1918 Safety record, the registrar shall deliver to each registered voter
2019 whose name appears on the list a written notice requiring the voter
2120 to submit to the registrar proof of United States citizenship in the
2221 form of a certified copy of the voter's birth certificate, United
2322 States passport, or certificate of naturalization or any other form
2423 prescribed by the secretary of state. The notice shall be delivered
2524 by forwardable mail to the mailing address on the voter's
2625 registration application and to any new address of the voter known
2726 to the registrar.
2827 (a-1) The secretary of state shall enter into an agreement
2928 with the Department of Public Safety under which information in the
3029 statewide computerized voter registration list is compared against
3130 information in the database of the Department of Public Safety on a
3231 monthly basis to verify the accuracy of citizenship status
3332 information provided on voter registration applications. The
3433 information compared must include, at a minimum, a voter's:
3534 (1) full legal name;
3635 (2) former name, if applicable;
3736 (3) date of birth;
3837 (4) residence address;
3938 (5) driver's license or state identification card
4039 number;
4140 (6) social security number;
4241 (7) documentation of lawful presence in this state;
4342 and
4443 (8) citizenship status.
4544 (d) The secretary of state shall prescribe rules for the
4645 administration of this section.
4746 (e) Not later than December 31 of each year, the secretary
4847 of state shall provide a report to the legislature of the number of
4948 voter registrations canceled under this section during the calendar
5049 year.
5150 SECTION 2. This Act takes effect immediately if it receives
5251 a vote of two-thirds of all the members elected to each house, as
5352 provided by Section 39, Article III, Texas Constitution. If this
5453 Act does not receive the vote necessary for immediate effect, this
5554 Act takes effect September 1, 2021.
