57 relating to participation in the comptroller's contracts for travel

79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 2171.055, Government Code, is amended by
911 amending Subsections (e), (f), (g), (h), (i), and (j) and adding
1012 Subsection (k) to read as follows:
1113 (e) A county officer or employee who is engaged in official
1214 county business may participate in the comptroller's contract for
1315 travel services for the purpose of obtaining reduced airline fares
1416 and reduced travel agent fees. A county sheriff or deputy sheriff
1517 or juvenile probation officer who is transporting a state prisoner
1618 under a felony warrant may participate in the comptroller's
1719 contract for travel services for purposes of obtaining reduced
1820 airline fares and reduced travel agent fees for the law enforcement
1921 or probation officer and the prisoner. [The comptroller may charge
2022 a participating county a fee not to exceed the costs incurred by the
2123 comptroller in providing services under this subsection. The
2224 comptroller shall periodically review fees and shall adjust them as
2325 needed to ensure recovery of costs incurred in providing services
2426 to counties under this subsection. The comptroller shall deposit
2527 the fees collected under this subsection to the credit of the county
2628 airline fares account. The county airline fares account is an
2729 account in the general revenue fund that may be appropriated only
2830 for the purposes of this chapter.] The comptroller shall adopt
2931 rules and make or amend contracts as necessary to administer this
3032 subsection.
3133 (f) An officer or employee of a public junior college, as
3234 defined by Section 61.003, Education Code, of an open-enrollment
3335 charter school established under Subchapter D, Chapter 12,
3436 Education Code, or of a school district who is engaged in official
3537 business may participate in the comptroller's contract for travel
3638 services. [The comptroller may charge a participating public
3739 junior college, open-enrollment charter school, or school district
3840 a fee not to exceed the costs incurred by the comptroller in
3941 providing services under this subsection. The comptroller shall
4042 periodically review fees and shall adjust them as needed to ensure
4143 recovery of costs incurred in providing services to public junior
4244 colleges, open-enrollment charter schools, and school districts
4345 under this subsection. The comptroller shall deposit the fees
4446 collected under this subsection to the credit of the public
4547 education travel account. The public education travel account is
4648 an account in the general revenue fund that may be appropriated only
4749 for the purposes of this chapter.] The comptroller shall adopt
4850 rules and make or amend contracts as necessary to administer this
4951 subsection.
5052 (g) A municipal officer or employee who is engaged in
5153 official municipal business may participate in the comptroller's
5254 contract for travel services for the purpose of obtaining reduced
5355 airline fares and reduced travel agent fees. [The comptroller may
5456 charge a participating municipality a fee not to exceed the costs
5557 incurred by the comptroller in providing services under this
5658 subsection. The comptroller shall periodically review fees and
5759 shall adjust them as needed to ensure recovery of costs incurred in
5860 providing services to municipalities under this subsection. The
5961 comptroller shall deposit the fees collected under this subsection
6062 to the credit of the municipality airline fares account. The
6163 municipality airline fares account is an account in the general
6264 revenue fund that may be appropriated only for the purposes of this
6365 chapter.] The comptroller shall adopt rules and make or amend
6466 contracts as necessary to administer this subsection.
6567 (h) A board member or employee of a communication district
6668 or an emergency communication district established under Chapter
6769 772, Health and Safety Code, who is engaged in official district
6870 business may participate in the comptroller's contract for travel
6971 services for the purpose of obtaining reduced airline fares and
7072 reduced travel agent fees. [The comptroller may charge a
7173 participating district a fee not to exceed the costs incurred by the
7274 comptroller in providing services under this subsection. The
7375 comptroller shall periodically review fees and shall adjust them as
7476 needed to ensure recovery of costs incurred in providing services
7577 to districts under this subsection. The comptroller shall deposit
7678 the fees collected under this subsection to the credit of the
7779 emergency communication district airline fares account. The
7880 emergency communication district airline fares account is an
7981 account in the general revenue fund that may be appropriated only
8082 for the purposes of this chapter.] The comptroller shall adopt
8183 rules and make or amend contracts as necessary to administer this
8284 subsection.
8385 (i) An officer or employee of a transportation or transit
8486 authority, department, district, or system established under
8587 Subtitle K, Title 6, Transportation Code, who is engaged in
8688 official business of the authority, department, district, or system
8789 may participate in the comptroller's contracts for travel services.
8890 [The comptroller may charge a participating authority, department,
8991 district, or system a fee not to exceed the costs incurred by the
9092 comptroller in providing services under this subsection. The
9193 comptroller shall periodically review fees and shall adjust them as
9294 needed to ensure recovery of costs incurred in providing services
9395 to authorities, departments, districts, and systems under this
9496 subsection.]
9597 (j) An officer or employee of a hospital district created
9698 under general or special law who is engaged in official hospital
9799 district business may participate in the comptroller's contract for
98100 travel services for the purpose of obtaining reduced airline fares
99101 and reduced travel agent fees. [The comptroller may charge a
100102 participating hospital district a fee not to exceed the costs
101103 incurred by the comptroller in providing services under this
102104 subsection. The comptroller shall periodically review fees and
103105 shall adjust them as needed to ensure recovery of costs incurred in
104106 providing services to hospital districts under this subsection.
105107 The comptroller shall deposit the fees collected under this
106108 subsection to the credit of the hospital district airline fares
107109 account. The hospital district airline fares account is an account
108110 in the general revenue fund that may be appropriated only for the
109111 purposes of this chapter.] The comptroller shall adopt rules and
110112 make or amend contracts as necessary to administer this subsection.
111113 (k) An officer or employee of a qualified cooperative entity
112114 who is engaged in official business of the qualified cooperative
113115 entity may participate in the comptroller's contracts for travel
114116 services. The comptroller shall adopt rules and make or amend
115117 contracts as necessary to administer this subsection. For purposes
116118 of this subsection, a "qualified cooperative entity" includes:
117119 (1) a local government, as defined by Section 271.081,
118120 Local Government Code;
119121 (2) a community center for mental health and mental
120122 retardation services described by Section 2155.202(1);
121123 (3) an assistance organization, as defined by Section
122124 2175.001, that receives any state funds; and
123125 (4) a political subdivision, as defined by Section
124126 791.003.
125127 SECTION 2. This Act takes effect immediately if it receives
126128 a vote of two-thirds of all the members elected to each house, as
127129 provided by Section 39, Article III, Texas Constitution. If this
128130 Act does not receive the vote necessary for immediate effect, this
129131 Act takes effect September 1, 2021.
