46 AN ACT
57 relating to the provision of certain massage therapy instruction
68 using distance learning.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 455.156, Occupations Code, is amended by
911 amending Subsection (b) and adding Subsection (c) to read as
1012 follows:
1113 (b) An applicant for a license under this section must be an
1214 individual and:
1315 (1) present evidence satisfactory to the department
1416 that the person has satisfactorily completed massage therapy
1517 studies in a 500-hour minimum, supervised course of instruction in
1618 a manner provided by Subsection (c) [provided by a massage therapy
1719 instructor at a massage school, a licensed massage school, a
1820 state-approved educational institution, or any combination of
1921 instructors or schools], in which at least:
2022 (A) 200 hours are taught by a licensed massage
2123 therapy instructor and dedicated to the study of massage therapy
2224 techniques and theory and the practice of manipulation of soft
2325 tissue, with at least 125 hours dedicated to the study of Swedish
2426 massage therapy techniques;
2527 (B) 50 hours are dedicated to the study of
2628 anatomy;
2729 (C) 25 hours are dedicated to the study of
2830 physiology;
2931 (D) 50 hours are dedicated to the study of
3032 kinesiology;
3133 (E) 40 hours are dedicated to the study of
3234 pathology;
3335 (F) 20 hours are dedicated to the study of
3436 hydrotherapy;
3537 (G) 45 hours are dedicated to the study of
3638 massage therapy laws and rules, business practices, and
3739 professional ethics standards;
3840 (H) 20 hours are dedicated to the study of
3941 health, hygiene, first aid, universal precautions, and
4042 cardiopulmonary resuscitation (CPR); and
4143 (I) 50 hours are spent in an internship program;
4244 (2) pass the required examinations; and
4345 (3) be at least 18 years of age.
4446 (c) The hours of instruction required by Subsection (b) must
4547 be provided by a massage therapy instructor at a massage school,
4648 licensed massage school, state-approved educational institution,
4749 or any combination of instructors or schools. The hours of
4850 instruction required by Subsections (b)(1)(B)-(H) may be provided
4951 using distance learning. Distance learning is not limited to live
5052 instruction.
5153 SECTION 2. An applicant for a massage therapist license may
5254 satisfy the requirements of Sections 455.156(b)(1)(B)-(H),
5355 Occupations Code, using distance learning as provided by Section
5456 455.156(c), Occupations Code, as added by this Act, regardless of
5557 whether the application is submitted before, on, or after the
5658 effective date of this Act.
5759 SECTION 3. Not later than December 1, 2021, the Texas
5860 Commission of Licensing and Regulation shall adopt rules necessary
5961 to implement the changes in law made by this Act.
6062 SECTION 4. This Act takes effect immediately if it receives
6163 a vote of two-thirds of all the members elected to each house, as
6264 provided by Section 39, Article III, Texas Constitution. If this
6365 Act does not receive the vote necessary for immediate effect, this
6466 Act takes effect September 1, 2021.
