411 A BILL TO BE ENTITLED
512 AN ACT
613 relating to referrals to and consent to services under certain
714 programs designed to serve pregnant women and families.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. Section 265.101, Family Code, is amended by
1017 amending Subdivision (1) and adding Subdivisions (1-a) and (1-b) to
1118 read as follows:
1219 (1) "Commission" means the Health and Human Services
1320 Commission.
1421 (1-a) "Competitive grant program" means the
1522 nurse-family partnership competitive grant program established
1623 under this subchapter.
1724 (1-b) "Health and human services agencies" has the
1825 meaning assigned by Section 531.001, Government Code.
1926 SECTION 2. Subchapter C, Chapter 265, Family Code, is
2027 amended by adding Section 265.1025 to read as follows:
2128 Sec. 265.1025. COORDINATION BETWEEN AGENCIES AND LOCAL
2229 ORGANIZATIONS. The department shall coordinate with the commission
2330 to promote the referral to a partnership program of pregnant women
2431 receiving services through a public benefits program administered
2532 by the commission or a health and human services agency. The
2633 coordination may include encouraging and supporting agreements
2734 between local organizations providing services to pregnant women.
2835 SECTION 3. Section 265.154(b), Family Code, is amended to
2936 read as follows:
3037 (b) A report submitted under this section must include:
3138 (1) a description of the parenting education programs
3239 implemented and of the models associated with the programs;
3340 (2) information on the families served by the
3441 programs, including the number of families served and their
3542 demographic information;
3643 (3) the goals and achieved outcomes of the programs;
3744 (4) information on the cost for each family served,
3845 including any available third-party return-on-investment analysis;
3946 [and]
4047 (5) information explaining the percentage of money
4148 spent on evidence-based programs and on promising practice
4249 programs; and
4350 (6) the sources from which pregnant women were
4451 referred in the preceding two-year period to a nurse-family
4552 partnership program under Subchapter C.
4653 SECTION 4. Section 531.982, Government Code, is amended by
4754 adding Subsection (d) to read as follows:
4855 (d) A minor who is otherwise eligible for a home visiting
4956 program may consent to enrollment in and to receive services from a
5057 home visiting program. For purposes of this subsection, "minor"
5158 means an individual who is younger than 18 years of age.
5259 SECTION 5. If before implementing any provision of this Act
5360 a state agency determines that a waiver or authorization from a
5461 federal agency is necessary for implementation of that provision,
5562 the agency affected by the provision shall request the waiver or
5663 authorization and may delay implementing that provision until the
5764 waiver or authorization is granted.
5865 SECTION 6. This Act takes effect September 1, 2021.
