46 AN ACT
57 relating to the applicability of certain utility provisions to a
68 vehicle charging service.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Sections 31.002(6) and (17), Utilities Code, are
911 amended to read as follows:
1012 (6) "Electric utility" means a person or river
1113 authority that owns or operates for compensation in this state
1214 equipment or facilities to produce, generate, transmit,
1315 distribute, sell, or furnish electricity in this state. The term
1416 includes a lessee, trustee, or receiver of an electric utility and a
1517 recreational vehicle park owner who does not comply with Subchapter
1618 C, Chapter 184, with regard to the metered sale of electricity at
1719 the recreational vehicle park. The term does not include:
1820 (A) a municipal corporation;
1921 (B) a qualifying facility;
2022 (C) a power generation company;
2123 (D) an exempt wholesale generator;
2224 (E) a power marketer;
2325 (F) a corporation described by Section 32.053 to
2426 the extent the corporation sells electricity exclusively at
2527 wholesale and not to the ultimate consumer;
2628 (G) an electric cooperative;
2729 (H) a retail electric provider;
2830 (I) this state or an agency of this state; or
2931 (J) a person not otherwise an electric utility
3032 who:
3133 (i) furnishes an electric service or
3234 commodity only to itself, its employees, or its tenants as an
3335 incident of employment or tenancy, if that service or commodity is
3436 not resold to or used by others;
3537 (ii) owns or operates in this state
3638 equipment or facilities to produce, generate, transmit,
3739 distribute, sell, or furnish electric energy to an electric
3840 utility, if the equipment or facilities are used primarily to
3941 produce and generate electric energy for consumption by that
4042 person; [or]
4143 (iii) owns or operates in this state a
4244 recreational vehicle park that provides metered electric service in
4345 accordance with Subchapter C, Chapter 184; or
4446 (iv) owns or operates equipment used solely
4547 to provide electricity charging service for consumption by an
4648 alternatively fueled vehicle, as defined by Section 502.004,
4749 Transportation Code.
4850 (17) "Retail electric provider" means a person that
4951 sells electric energy to retail customers in this state. A retail
5052 electric provider may not own or operate generation assets. The
5153 term does not include a person not otherwise a retail electric
5254 provider who owns or operates equipment used solely to provide
5355 electricity charging service for consumption by an alternatively
5456 fueled vehicle, as defined by Section 502.004, Transportation Code.
5557 SECTION 2. Subchapter A, Chapter 31, Utilities Code, is
5658 amended by adding Section 31.0021 to read as follows:
5759 Sec. 31.0021. CHARGING SERVICE. The commission by rule may
5860 exempt from the definition of "electric utility" or "retail
5961 electric provider" under Section 31.002 a provider who owns or
6062 operates equipment used solely to provide electricity charging
6163 service for a mode of transportation.
6264 SECTION 3. Section 37.001(3), Utilities Code, is amended to
6365 read as follows:
6466 (3) "Retail electric utility" means a person,
6567 political subdivision, electric cooperative, or agency that
6668 operates, maintains, or controls in this state a facility to
6769 provide retail electric utility service. The term does not include
6870 a corporation described by Section 32.053 to the extent that the
6971 corporation sells electricity exclusively at wholesale and not to
7072 the ultimate consumer. A qualifying cogenerator that sells
7173 electric energy at retail to the sole purchaser of the
7274 cogenerator's thermal output under Sections 35.061 and 36.007 is
7375 not for that reason considered to be a retail electric utility. The
7476 owner or operator of a qualifying cogeneration facility who was
7577 issued the necessary environmental permits from the Texas Natural
7678 Resource Conservation Commission after January 1, 1998, and who
7779 commenced construction of such qualifying facility before July 1,
7880 1998, may provide electricity to the purchasers of the thermal
7981 output of that qualifying facility and shall not for that reason be
8082 considered an electric utility or a retail electric utility,
8183 provided that the purchasers of the thermal output are owners of
8284 manufacturing or process operation facilities that are located on a
8385 site entirely owned before September, 1987, by one owner who
8486 retained ownership after September, 1987, of some portion of the
8587 facilities and that those facilities now share some integrated
8688 operations, such as the provision of services and raw materials. A
8789 person who owns or operates equipment used solely to provide
8890 electricity charging service for consumption by an alternatively
8991 fueled vehicle, as defined by Section 502.004, Transportation Code,
9092 is not for that reason considered to be a retail electric utility.
9193 SECTION 4. Subchapter A, Chapter 37, Utilities Code, is
9294 amended by adding Section 37.002 to read as follows:
9395 Sec. 37.002. CHARGING SERVICE. The commission may by rule
9496 exempt from the definition of "retail electric utility" under
9597 Section 37.001 a provider who owns or operates equipment used
9698 solely to provide electricity charging service for a mode of
9799 transportation.
98100 SECTION 5. This Act takes effect September 1, 2021.
