57 relating to adoption by law enforcement agencies of a mental health
68 leave policy for peace officers.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Chapter 614, Government Code, is amended by
911 adding Subchapter A-1 to read as follows:
1012 SUBCHAPTER A-1. MENTAL HEALTH LEAVE
1113 Sec. 614.015. MENTAL HEALTH LEAVE FOR PEACE OFFICERS. (a)
1214 In this section, "law enforcement agency" means an agency of the
1315 state or an agency of a political subdivision of the state
1416 authorized by law to employ peace officers.
1517 (b) Each law enforcement agency shall develop and adopt a
1618 policy allowing the use of mental health leave by the peace officers
1719 employed by the agency who experience a traumatic event in the scope
1820 of that employment.
1921 (c) The mental health leave policy adopted under this
2022 section must:
2123 (1) provide clear and objective guidelines
2224 establishing the circumstances under which a peace officer is
2325 granted mental health leave and may use mental health leave;
2426 (2) entitle a peace officer to mental health leave
2527 without a deduction in salary or other compensation;
2628 (3) enumerate the number of mental health leave days
2729 available to a peace officer; and
2830 (4) detail the level of anonymity for a peace officer
2931 who takes mental health leave.
3032 (d) The mental health leave policy adopted under this
3133 section may provide a list of mental health services available to
3234 peace officers in the area of the law enforcement agency.
3335 SECTION 2. As soon as practicable after the effective date
3436 of this Act, each law enforcement agency shall develop the mental
3537 health leave policy required by Section 614.015, Government Code,
3638 as added by this Act.
3739 SECTION 3. This Act takes effect September 1, 2021.
