59 relating to withdrawals of water from the Edwards Aquifer to supply
610 a military installation.
711 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
812 SECTION 1. The heading to Section 1.33, Chapter 626, Acts of
913 the 73rd Legislature, Regular Session, 1993, is amended to read as
1014 follows:
1115 Sec. 1.33. WELL METERING AND PERMITTING EXEMPTIONS
1216 [EXEMPTION].
1317 SECTION 2. Section 1.33, Chapter 626, Acts of the 73rd
1418 Legislature, Regular Session, 1993, is amended by adding
1519 Subsections (e), (f), and (g) to read as follows:
1620 (e) In addition to permitted withdrawals from the aquifer, a
1721 municipally owned utility owned by the City of San Antonio, without
1822 a permit, may withdraw groundwater from the aquifer if:
1923 (1) the utility uses the groundwater to supply a
2024 military installation with water for human consumption,
2125 irrigation, operations, mission support, or infrastructure
2226 maintenance;
2327 (2) the utility and the military installation enter
2428 into a contract requiring the installation to reduce its
2529 groundwater withdrawals from the aquifer by the same amount of
2630 withdrawn water the installation receives from the utility; and
2731 (3) the utility complies with rules adopted by the
2832 authority that allow the authority to monitor groundwater
2933 withdrawals from the aquifer by the utility and determine amounts
3034 of groundwater exempted from permitting in accordance with this
3135 subsection, including rules requiring the reporting of amounts
3236 supplied by the utility to the military installation and amounts by
3337 which the military installation reduces the installation's
3438 groundwater withdrawals from the aquifer.
3539 (f) Subsection (e) of this section does not alter the
3640 obligations of a military installation under a biological opinion
3741 issued by a federal agency.
3842 (g) The amount of water provided by a municipally owned
3943 utility to a military installation under Subsection (e) of this
4044 section may not exceed the maximum amount of water that the military
4145 installation is authorized to withdraw from the aquifer under a
4246 biological opinion issued by a federal agency.
4347 SECTION 3. This Act takes effect September 1, 2021.
