7 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 12 | | SECTION 1. The heading to Section 1.33, Chapter 626, Acts of |
---|
9 | 13 | | the 73rd Legislature, Regular Session, 1993, is amended to read as |
---|
10 | 14 | | follows: |
---|
11 | 15 | | Sec. 1.33. WELL METERING AND PERMITTING EXEMPTIONS |
---|
12 | 16 | | [EXEMPTION]. |

13 | 17 | | SECTION 2. Section 1.33, Chapter 626, Acts of the 73rd |
---|
14 | 18 | | Legislature, Regular Session, 1993, is amended by adding |
---|
15 | 19 | | Subsections (e), (f), and (g) to read as follows: |
---|
16 | 20 | | (e) In addition to permitted withdrawals from the aquifer, a |
---|
17 | 21 | | municipally owned utility owned by the City of San Antonio, without |
---|
18 | 22 | | a permit, may withdraw groundwater from the aquifer if: |
---|
19 | 23 | | (1) the utility uses the groundwater to supply a |
---|
20 | 24 | | military installation with water for human consumption, |
---|
21 | 25 | | irrigation, operations, mission support, or infrastructure |
---|
22 | 26 | | maintenance; |
---|
23 | 27 | | (2) the utility and the military installation enter |
---|
24 | 28 | | into a contract requiring the installation to reduce its |
---|
25 | 29 | | groundwater withdrawals from the aquifer by the same amount of |
---|
26 | 30 | | withdrawn water the installation receives from the utility; and |
---|
27 | 31 | | (3) the utility complies with rules adopted by the |
---|
28 | 32 | | authority that allow the authority to monitor groundwater |
---|
29 | 33 | | withdrawals from the aquifer by the utility and determine amounts |
---|
30 | 34 | | of groundwater exempted from permitting in accordance with this |
---|
31 | 35 | | subsection, including rules requiring the reporting of amounts |
---|
32 | 36 | | supplied by the utility to the military installation and amounts by |
---|
33 | 37 | | which the military installation reduces the installation's |
---|
34 | 38 | | groundwater withdrawals from the aquifer. |
---|
35 | 39 | | (f) Subsection (e) of this section does not alter the |
---|
36 | 40 | | obligations of a military installation under a biological opinion |
---|
37 | 41 | | issued by a federal agency. |
---|
38 | 42 | | (g) The amount of water provided by a municipally owned |
---|
39 | 43 | | utility to a military installation under Subsection (e) of this |
---|
40 | 44 | | section may not exceed the maximum amount of water that the military |
---|
41 | 45 | | installation is authorized to withdraw from the aquifer under a |
---|
42 | 46 | | biological opinion issued by a federal agency. |
---|
43 | 47 | | SECTION 3. This Act takes effect September 1, 2021. |
