| 6 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 11 | | SECTION 1. Sections 251.005 and 251.018, Transportation |
|---|
| 8 | 12 | | Code, are repealed. |
|---|
| 9 | 13 | | SECTION 2. Section 252.006(e), Transportation Code, is |
|---|
| 10 | 14 | | amended to read as follows: |
|---|
| 11 | 15 | | (e) An ex officio road commissioner has the duties of a |
|---|
| 12 | 16 | | supervisor of public roads as provided by Section [Sections] |
|---|
| 13 | 17 | | 251.004 [and 251.005]. |
|---|
| 14 | 18 | | SECTION 3. Section 256.104(a), Transportation Code, is |
|---|
| 15 | 19 | | amended to read as follows: |
|---|
| 16 | 20 | | (a) In applying for a grant under this subchapter, the |
|---|
| 17 | 21 | | county shall[: |
|---|
| 18 | 22 | | [(1) provide the road condition report described by |
|---|
| 19 | 23 | | Section 251.018 made by the county for the previous year; and |
|---|
| 20 | 24 | | [(2)] submit to the department a plan that: |
|---|
| 21 | 25 | | (1) [(A)] provides a list of transportation |
|---|
| 22 | 26 | | infrastructure projects to be funded by the grant; |
|---|
| 23 | 27 | | (2) [(B)] describes the scope of the transportation |
|---|
| 24 | 28 | | infrastructure project or projects to be funded by the grant using |
|---|
| 25 | 29 | | best practices for prioritizing the projects; |
|---|
| 26 | 30 | | (3) [(C)] provides for matching funds as required by |
|---|
| 27 | 31 | | Section 256.105; and |
|---|
| 28 | 32 | | (4) [(D)] meets any other requirements imposed by the |
|---|
| 29 | 33 | | department. |
|---|
| 30 | 34 | | SECTION 4. Section 256.106(a), Transportation Code, is |
|---|
| 31 | 35 | | amended to read as follows: |
|---|
| 32 | 36 | | (a) A county that makes a second or subsequent application |
|---|
| 33 | 37 | | for a grant from the department under this subchapter must: |
|---|
| 34 | 38 | | (1) [provide the department with a copy of a report |
|---|
| 35 | 39 | | filed under Section 251.018; |
|---|
| 36 | 40 | | [(2)] certify that all previous grants are being spent |
|---|
| 37 | 41 | | in accordance with the plan submitted under Section 256.104; and |
|---|
| 38 | 42 | | (2) [(3)] provide an accounting of how previous grants |
|---|
| 39 | 43 | | were spent, including any amounts spent on administrative costs. |
|---|
| 40 | 44 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 41 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 48 | | Act takes effect September 1, 2021. |
