59 relating to county road reports.
610 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
711 SECTION 1. Sections 251.005 and 251.018, Transportation
812 Code, are repealed.
913 SECTION 2. Section 252.006(e), Transportation Code, is
1014 amended to read as follows:
1115 (e) An ex officio road commissioner has the duties of a
1216 supervisor of public roads as provided by Section [Sections]
1317 251.004 [and 251.005].
1418 SECTION 3. Section 256.104(a), Transportation Code, is
1519 amended to read as follows:
1620 (a) In applying for a grant under this subchapter, the
1721 county shall[:
1822 [(1) provide the road condition report described by
1923 Section 251.018 made by the county for the previous year; and
2024 [(2)] submit to the department a plan that:
2125 (1) [(A)] provides a list of transportation
2226 infrastructure projects to be funded by the grant;
2327 (2) [(B)] describes the scope of the transportation
2428 infrastructure project or projects to be funded by the grant using
2529 best practices for prioritizing the projects;
2630 (3) [(C)] provides for matching funds as required by
2731 Section 256.105; and
2832 (4) [(D)] meets any other requirements imposed by the
2933 department.
3034 SECTION 4. Section 256.106(a), Transportation Code, is
3135 amended to read as follows:
3236 (a) A county that makes a second or subsequent application
3337 for a grant from the department under this subchapter must:
3438 (1) [provide the department with a copy of a report
3539 filed under Section 251.018;
3640 [(2)] certify that all previous grants are being spent
3741 in accordance with the plan submitted under Section 256.104; and
3842 (2) [(3)] provide an accounting of how previous grants
3943 were spent, including any amounts spent on administrative costs.
4044 SECTION 5. This Act takes effect immediately if it receives
4145 a vote of two-thirds of all the members elected to each house, as
4246 provided by Section 39, Article III, Texas Constitution. If this
4347 Act does not receive the vote necessary for immediate effect, this
4448 Act takes effect September 1, 2021.
