7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 5010.0104, Special District Local Laws |
---|
9 | 11 | | Code, is amended to read as follows: |

10 | 12 | | Sec. 5010.0104. DISTRICT TERRITORY. The district is |
---|
11 | 13 | | composed of the territory: |
---|
12 | 14 | | (1) in Jefferson and Orange Counties described by |
---|
13 | 15 | | Sections 1 and 1A, Chapter 147, Acts of the 51st Legislature, |
---|
14 | 16 | | Regular Session, 1949, as that territory may have been modified |
---|
15 | 17 | | under: |
---|
16 | 18 | | (A) [(1)] Section 3 or 3a, Chapter 103, Acts of |
---|
17 | 19 | | the 41st Legislature, 1st Called Session, 1929 (Article 8263a, |
---|
18 | 20 | | Vernon's Texas Civil Statutes), before August 30, 1971; |
---|
19 | 21 | | (B) [(2)] Subchapter H, Chapter 62, Water Code; |

24 | 26 | | SECTION 2. Chapter 5010, Special District Local Laws Code, |
---|
25 | 27 | | is amended by adding Subchapter F to read as follows: |

26 | 28 | | SUBCHAPTER F. SPECIAL PURPOSE AREA |
---|
27 | 29 | | Sec. 5010.0601. DEFINITION. In this subchapter, "special |
---|
28 | 30 | | purpose area" means the territory described by Section 3 of the Act |
---|
29 | 31 | | enacting this subchapter. |
---|
30 | 32 | | Sec. 5010.0602. REPORTING OF CARGO AND VESSEL MOVEMENTS. |
---|
31 | 33 | | Waterborne commercial cargo and vessel movements originating in or |
---|
32 | 34 | | departing from the special purpose area may be attributed as |
---|
33 | 35 | | waterborne commercial cargo or vessel movements originating in or |
---|
34 | 36 | | departing from the district for the purpose of reporting to the |
---|
35 | 37 | | United States Army Corps of Engineers under applicable federal law. |
---|
36 | 38 | | Sec. 5010.0603. EFFECT ON OTHER DISTRICTS. The inclusion |
---|
37 | 39 | | of the special purpose area in the district does not affect any |
---|
38 | 40 | | powers or duties exercised in the special purpose area by the |
---|
39 | 41 | | Sabine-Neches Navigation District or the Orange County Navigation |
---|
40 | 42 | | and Port District. |
---|
41 | 43 | | Sec. 5010.0604. TAXATION PROHIBITED. The district may not |
---|
42 | 44 | | impose a tax in the special purpose area. |

43 | 45 | | SECTION 3. The Port of Beaumont Navigation District of |

142 | 144 | | copy of this Act have been furnished to all persons, agencies, |
---|
143 | 145 | | officials, or entities to which they are required to be furnished |

144 | 146 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
145 | 147 | | Government Code. |

146 | 148 | | (b) The governor, one of the required recipients, has |
---|
147 | 149 | | submitted the notice and Act to the Texas Commission on |
---|
148 | 150 | | Environmental Quality. |
---|
149 | 151 | | (c) The Texas Commission on Environmental Quality has filed |
---|
150 | 152 | | its recommendations relating to this Act with the governor, the |
---|
151 | 153 | | lieutenant governor, and the speaker of the house of |
---|
152 | 154 | | representatives within the required time. |
---|
153 | 155 | | (d) All requirements of the constitution and laws of this |
---|
154 | 156 | | state and the rules and procedures of the legislature with respect |
---|
155 | 157 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
156 | 158 | | and accomplished. |

157 | 159 | | SECTION 5. This Act takes effect immediately if it receives |
---|
158 | 160 | | a vote of two-thirds of all the members elected to each house, as |
---|
159 | 161 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
160 | 162 | | Act does not receive the vote necessary for immediate effect, this |
---|
161 | 163 | | Act takes effect September 1, 2021. |
