4	8		AN ACT
5	9		relating to certification and examination requirements for persons
6	10		engaged in liquefied petroleum gas activities.
7	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	12		SECTION 1. The heading to Section 113.095, Natural
9	13		Resources Code, is amended to read as follows:
10	14		Sec. 113.095. LICENSE AND EXAMINATION BY ENDORSEMENT:
11	15		OUT-OF-STATE LICENSE OR CERTIFICATION.
12	16		SECTION 2. Subchapter D, Chapter 113, Natural Resources
13	17		Code, is amended by adding Section 113.0955 to read as follows:
14	18		Sec. 113.0955. CERTIFICATION AND EXAMINATION BY
15	19		ENDORSEMENT: NATIONALLY RECOGNIZED TRAINING. The commission by
16	20		rule shall waive the requirements of Section 113.087 for an
17	21		applicant for a certificate for cylinder filling who:
18	22		(1) has completed training consistent with the
19	23		guidelines established by the Propane Education & Research Council;
20	24		(2) submits proof of completion of training described
21	25		by Subdivision (1);
22	26		(3) submits an application for that type of
23	27		certificate;
24	28		(4) pays the applicable original nonrefundable
25	29		certification fee as established by the commission under Section
26	30		113.088; and
27	31		(5) completes an examination for cylinder filling
28	32		that:
29	33		(A) is administered by the commission;
30	34		(B) is approved by the commission as a comparable
31	35		examination to the examination administered by the commission and
32	36		submits proof of completion of the examination to the commission;
33	37		or
34	38		(C) uses Propane Education & Research Council
35	39		training and examination materials and submits proof of completion
36	40		of the examination to the commission.
37	41		SECTION 3. This Act takes effect September 1, 2021.
