76 relating to procedures for early voting by mail.
87 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
98 SECTION 1. Chapter 81, Election Code, is amended by adding
109 Section 81.006 to read as follows:
1110 Sec. 81.006. MODIFICATION OF EARLY VOTING BY MAIL
1211 QUALIFICATIONS AND PROCEDURES. Except as specifically permitted by
1312 statute, the qualifications for early voting by mail and procedures
1413 for conducting early voting by mail may not be amended or suspended
1514 for any reason.
1615 SECTION 2. Section 418.016, Government Code, is amended by
1716 adding Subsection (i) to read as follows:
1817 (i) Notwithstanding Subsection (a) and except as provided
1918 by this subsection, the governor may not suspend a provision of a
2019 statute, an order, or a rule under this section if the provision,
2120 order, or rule is related to the qualifications or procedures for
2221 early voting by mail. Upon declaration of a state of disaster, the
2322 governor may suspend Section 86.006(a-1), Election Code, only for
2423 the purpose of allowing a voter registered to vote at an address
2524 located in a disaster area to deliver a marked ballot voted under
2625 Section 86.006(a-1) to the early voting clerk's office on or before
2726 election day.
2827 SECTION 3. Section 418.108, Government Code, is amended by
2928 adding Subsection (j) to read as follows:
3029 (j) The presiding officer of the governing body of a
3130 political subdivision may not suspend a provision of a statute,
3231 rule, or order under this section if the statute, rule, or order is
3332 related to the qualifications or procedures for early voting by
3433 mail.
3534 SECTION 4. This Act takes effect September 1, 2021.
