| 8 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 16 | | SECTION 1. Subchapter B, Chapter 55, Education Code, is |

| 10 | 17 | | amended by adding Section 55.111 to read as follows: |

| 11 | 18 | | Sec. 55.111. CERTAIN ALLOCATED FUNDS TO BE DESIGNATED AS |

| 12 | 19 | | CAPITAL IMPROVEMENT DEBT ASSISTANCE. For purposes of this |

| 13 | 20 | | subchapter, funds allocated from the appropriation of general |
|---|
| 14 | 21 | | revenue to an institution of higher education to supplement revenue |

| 15 | 22 | | funds of the institution described by Section 55.13(a) may be |
|---|
| 16 | 23 | | designated as "Capital Improvement Debt Assistance." |

| 17 | 24 | | SECTION 2. This Act takes effect immediately if it receives |

| 18 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 19 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 20 | 27 | | Act does not receive the vote necessary for immediate effect, this |

| 21 | 28 | | Act takes effect September 1, 2021. |
