46 AN ACT
57 relating to the filing of certain reports of political
68 contributions and expenditures.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 254.036, Election Code, is amended by
911 adding Subsection (g) to read as follows:
1012 (g) In prescribing the format of a report filed under this
1113 chapter, including a report filed with an authority other than the
1214 commission under Subsection (a), the commission shall ensure that
1315 the report requires for political expenditures made with a credit
1416 card that:
1517 (1) the expenditures be reported in a single itemized
1618 list; and
1719 (2) the list include, stated by credit card issuer:
1820 (A) the name of the credit card issuer;
1921 (B) the date and amount of each expenditure; and
2022 (C) the date the credit card issuer was repaid
2123 for the expenditure.
2224 SECTION 2. Section 254.038(c), Election Code, is amended to
2325 read as follows:
2426 (c) A report under this section shall be filed
2527 electronically, by [telegram or] telephonic facsimile machine, or
2628 by hand, in the form required by Section 254.036. The commission
2729 must receive a report under this section filed by [telegram,]
2830 telephonic facsimile machine[,] or hand not later than 5 p.m. of the
2931 first business day after the date the contribution is accepted. The
3032 commission must receive a report under this section filed
3133 electronically not later than midnight of the first business day
3234 after the date the contribution is accepted. A report under this
3335 section is not required to be accompanied by the affidavit required
3436 under Section 254.036(h) or to be submitted on a form prescribed by
3537 the commission. A report under this section that complies with
3638 Section 254.036(a) must be accompanied by an affidavit under
3739 Section 254.036(c)(1) unless the candidate or committee has
3840 submitted an affidavit under Section 254.036(c)(1) with another
3941 report filed in connection with the election for which a report is
4042 required under this section.
4143 SECTION 3. Section 254.039(a-1), Election Code, is amended
4244 to read as follows:
4345 (a-1) A report under this section shall be filed
4446 electronically, by [telegram or] telephonic facsimile machine, or
4547 by hand, in the form required by Section 254.036. The commission
4648 must receive a report under this section not later than 5 p.m. of
4749 the first business day after the date the contribution is accepted
4850 or the expenditure is made. A report under this section is not
4951 required to be accompanied by the affidavit required under Section
5052 254.036(h) or to be submitted on a form prescribed by the
5153 commission. A report under this section that complies with Section
5254 254.036(a) must be accompanied by an affidavit under Section
5355 254.036(c)(1) unless the committee has submitted an affidavit under
5456 Section 254.036(c)(1) with another report filed in connection with
5557 the election for which a report is required under this section.
5658 SECTION 4. The changes in law made by this Act apply only to
5759 a report of political contributions and expenditures that is filed
5860 on or after the effective date of this Act. A report filed before
5961 the effective date of this Act is governed by the law in effect at
6062 the time the report was filed, and the former law is continued in
6163 effect for that purpose.
6264 SECTION 5. This Act takes effect September 1, 2021.
