| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 254.036, Election Code, is amended by |
|---|
| 9 | 11 | | adding Subsection (g) to read as follows: |
|---|
| 10 | 12 | | (g) In prescribing the format of a report filed under this |
|---|
| 11 | 13 | | chapter, including a report filed with an authority other than the |
|---|
| 12 | 14 | | commission under Subsection (a), the commission shall ensure that |
|---|
| 13 | 15 | | the report requires for political expenditures made with a credit |
|---|
| 14 | 16 | | card that: |
|---|
| 15 | 17 | | (1) the expenditures be reported in a single itemized |
|---|
| 16 | 18 | | list; and |
|---|
| 17 | 19 | | (2) the list include, stated by credit card issuer: |
|---|
| 18 | 20 | | (A) the name of the credit card issuer; |
|---|
| 19 | 21 | | (B) the date and amount of each expenditure; and |
|---|
| 20 | 22 | | (C) the date the credit card issuer was repaid |
|---|
| 21 | 23 | | for the expenditure. |
|---|
| 22 | 24 | | SECTION 2. Section 254.038(c), Election Code, is amended to |
|---|
| 23 | 25 | | read as follows: |
|---|
| 24 | 26 | | (c) A report under this section shall be filed |
|---|
| 25 | 27 | | electronically, by [telegram or] telephonic facsimile machine, or |
|---|
| 26 | 28 | | by hand, in the form required by Section 254.036. The commission |
|---|
| 27 | 29 | | must receive a report under this section filed by [telegram,] |
|---|
| 28 | 30 | | telephonic facsimile machine[,] or hand not later than 5 p.m. of the |
|---|
| 29 | 31 | | first business day after the date the contribution is accepted. The |
|---|
| 30 | 32 | | commission must receive a report under this section filed |
|---|
| 31 | 33 | | electronically not later than midnight of the first business day |
|---|
| 32 | 34 | | after the date the contribution is accepted. A report under this |
|---|
| 33 | 35 | | section is not required to be accompanied by the affidavit required |
|---|
| 34 | 36 | | under Section 254.036(h) or to be submitted on a form prescribed by |
|---|
| 35 | 37 | | the commission. A report under this section that complies with |
|---|
| 36 | 38 | | Section 254.036(a) must be accompanied by an affidavit under |
|---|
| 37 | 39 | | Section 254.036(c)(1) unless the candidate or committee has |
|---|
| 38 | 40 | | submitted an affidavit under Section 254.036(c)(1) with another |
|---|
| 39 | 41 | | report filed in connection with the election for which a report is |
|---|
| 40 | 42 | | required under this section. |

| 41 | 43 | | SECTION 3. Section 254.039(a-1), Election Code, is amended |
|---|
| 42 | 44 | | to read as follows: |
|---|
| 43 | 45 | | (a-1) A report under this section shall be filed |
|---|
| 44 | 46 | | electronically, by [telegram or] telephonic facsimile machine, or |
|---|
| 45 | 47 | | by hand, in the form required by Section 254.036. The commission |
|---|
| 46 | 48 | | must receive a report under this section not later than 5 p.m. of |
|---|
| 47 | 49 | | the first business day after the date the contribution is accepted |
|---|
| 48 | 50 | | or the expenditure is made. A report under this section is not |
|---|
| 49 | 51 | | required to be accompanied by the affidavit required under Section |
|---|
| 50 | 52 | | 254.036(h) or to be submitted on a form prescribed by the |
|---|
| 51 | 53 | | commission. A report under this section that complies with Section |
|---|
| 52 | 54 | | 254.036(a) must be accompanied by an affidavit under Section |
|---|
| 53 | 55 | | 254.036(c)(1) unless the committee has submitted an affidavit under |
|---|
| 54 | 56 | | Section 254.036(c)(1) with another report filed in connection with |
|---|
| 55 | 57 | | the election for which a report is required under this section. |

| 56 | 58 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 57 | 59 | | a report of political contributions and expenditures that is filed |
|---|
| 58 | 60 | | on or after the effective date of this Act. A report filed before |
|---|
| 59 | 61 | | the effective date of this Act is governed by the law in effect at |
|---|
| 60 | 62 | | the time the report was filed, and the former law is continued in |
|---|
| 61 | 63 | | effect for that purpose. |

| 62 | 64 | | SECTION 5. This Act takes effect September 1, 2021. |
