| 7 | 7 | | relating to prohibiting certain contracts or agreements between a |

| 8 | 8 | | public institution of higher education and a Confucius Institute. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 51.9235 to read as follows: |
|---|
| 12 | 12 | | Sec. 51.9235. CERTAIN AGREEMENTS WITH CONFUCIUS INSTITUTE |
|---|
| 13 | 13 | | PROHIBITED. (a) In this section, "institution of higher |
|---|
| 14 | 14 | | education" has the meaning assigned by Section 61.003. |
|---|
| 15 | 15 | | (b) Notwithstanding any other provision of this code, an |
|---|
| 16 | 16 | | institution of higher education that enters into a contract or |
|---|
| 17 | 17 | | other agreement with a Confucius Institute may not receive any |
|---|
| 18 | 18 | | state funding during the term of the contract or agreement unless |
|---|
| 19 | 19 | | the contract or agreement includes clear provisions that: |
|---|
| 20 | 20 | | (1) protect academic freedom at the institution; |
|---|
| 21 | 21 | | (2) prohibit the application of any foreign law on any |
|---|
| 22 | 22 | | campus of the institution; and |
|---|
| 23 | 23 | | (3) grant full managerial authority of the Confucius |
|---|
| 24 | 24 | | Institute to the institution, including full control over the |
|---|
| 25 | 25 | | subjects taught, the activities carried out, any research grants |
|---|
| 26 | 26 | | made, and the selection of employees by the Confucius Institute. |
|---|
| 27 | 27 | | (c) This section does not apply to funds that an institution |
|---|
| 28 | 28 | | of higher education is entitled to receive under the Texas |
|---|
| 29 | 29 | | Constitution. |
|---|
| 30 | 30 | | (d) The Texas Higher Education Coordinating Board shall |
|---|
| 31 | 31 | | adopt rules as necessary to implement this section. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2021. |
