55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting certain contracts or agreements between a
88 public institution of higher education and a Confucius Institute.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1111 amended by adding Section 51.9235 to read as follows:
1212 Sec. 51.9235. CERTAIN AGREEMENTS WITH CONFUCIUS INSTITUTE
1313 PROHIBITED. (a) In this section, "institution of higher
1414 education" has the meaning assigned by Section 61.003.
1515 (b) Notwithstanding any other provision of this code, an
1616 institution of higher education that enters into a contract or
1717 other agreement with a Confucius Institute may not receive any
1818 state funding during the term of the contract or agreement unless
1919 the contract or agreement includes clear provisions that:
2020 (1) protect academic freedom at the institution;
2121 (2) prohibit the application of any foreign law on any
2222 campus of the institution; and
2323 (3) grant full managerial authority of the Confucius
2424 Institute to the institution, including full control over the
2525 subjects taught, the activities carried out, any research grants
2626 made, and the selection of employees by the Confucius Institute.
2727 (c) This section does not apply to funds that an institution
2828 of higher education is entitled to receive under the Texas
2929 Constitution.
3030 (d) The Texas Higher Education Coordinating Board shall
3131 adopt rules as necessary to implement this section.
3232 SECTION 2. This Act takes effect September 1, 2021.
