 A BILL TO BE ENTITLED
 AN ACT
 relating to prohibiting certain contracts or agreements between a
 public institution of higher education and a Confucius Institute.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
 amended by adding Section 51.9235 to read as follows:
 Sec. 51.9235.  CERTAIN AGREEMENTS WITH CONFUCIUS INSTITUTE
 PROHIBITED. (a) In this section, "institution of higher
 education" has the meaning assigned by Section 61.003.
 (b)  Notwithstanding any other provision of this code, an
 institution of higher education that enters into a contract or
 other agreement with a Confucius Institute may not receive any
 state funding during the term of the contract or agreement unless
 the contract or agreement includes clear provisions that:
 (1)  protect academic freedom at the institution;
 (2)  prohibit the application of any foreign law on any
 campus of the institution; and
 (3)  grant full managerial authority of the Confucius
 Institute to the institution, including full control over the
 subjects taught, the activities carried out, any research grants
 made, and the selection of employees by the Confucius Institute.
 (c)  This section does not apply to funds that an institution
 of higher education is entitled to receive under the Texas
 Constitution.
 (d)  The Texas Higher Education Coordinating Board shall
 adopt rules as necessary to implement this section.
 SECTION 2.  This Act takes effect September 1, 2021.
