| 12 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 9 | | SECTION 1. Section 22.003, Education Code, is amended by |
|---|
| 14 | 10 | | adding Subsections (a-1) and (a-2) and amending Subsection (c-1) to |
|---|
| 15 | 11 | | read as follows: |
|---|
| 16 | 12 | | (a-1) In addition to all other days of leave provided by |
|---|
| 17 | 13 | | this section or by the school district, a school district shall |
|---|
| 18 | 14 | | provide one day of personal leave per district employee in a leave |
|---|
| 19 | 15 | | pool established by the district board of trustees in accordance |
|---|
| 20 | 16 | | with this subsection and Subsection (a-2). The district shall |
|---|
| 21 | 17 | | allow an employee to voluntarily contribute to the leave pool |
|---|
| 22 | 18 | | created under this subsection one or more additional days of |
|---|
| 23 | 19 | | personal leave accumulated by the employee. The district shall |
|---|
| 24 | 20 | | credit the leave pool with the number of days of personal leave |
|---|
| 25 | 21 | | contributed by the employee and deduct a corresponding number of |
|---|
| 26 | 22 | | days of leave from the employee's accrued personal leave as if the |
|---|
| 27 | 23 | | employee had taken the leave. |
|---|
| 28 | 24 | | (a-2) In establishing a leave pool under Subsection (a-1), |
|---|
| 29 | 25 | | the board of trustees of a school district shall adopt procedures |
|---|
| 30 | 26 | | for the administration and operation of the leave pool. The |
|---|
| 31 | 27 | | procedures must ensure that the number of days of personal leave |
|---|
| 32 | 28 | | that an employee is permitted to use from the leave pool is related |
|---|
| 33 | 29 | | to the number of personal days of leave contributed by the employee |
|---|
| 34 | 30 | | under Subsection (a-1). |
|---|
| 35 | 31 | | (c-1) Any informational handbook a school district provides |
|---|
| 36 | 32 | | to employees in an electronic or paper form or makes available by |
|---|
| 37 | 33 | | posting on the district website must include information on the |
|---|
| 38 | 34 | | leave pool created under Subsection (a-1) and notification of an |
|---|
| 39 | 35 | | employee's rights under Subsection (b) in the relevant section of |
|---|
| 40 | 36 | | the handbook. Any form used by a school district through which an |
|---|
| 41 | 37 | | employee may request leave under this section must include assault |
|---|
| 42 | 38 | | leave under Subsection (b) as an option. |
|---|
| 43 | 39 | | SECTION 2. This Act applies beginning with the 2021-2022 |
|---|
| 44 | 40 | | school year. |
|---|
| 45 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 45 | | Act takes effect September 1, 2021. |
