117 relating to a leave pool for school district employees.
128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
139 SECTION 1. Section 22.003, Education Code, is amended by
1410 adding Subsections (a-1) and (a-2) and amending Subsection (c-1) to
1511 read as follows:
1612 (a-1) In addition to all other days of leave provided by
1713 this section or by the school district, a school district shall
1814 provide one day of personal leave per district employee in a leave
1915 pool established by the district board of trustees in accordance
2016 with this subsection and Subsection (a-2). The district shall
2117 allow an employee to voluntarily contribute to the leave pool
2218 created under this subsection one or more additional days of
2319 personal leave accumulated by the employee. The district shall
2420 credit the leave pool with the number of days of personal leave
2521 contributed by the employee and deduct a corresponding number of
2622 days of leave from the employee's accrued personal leave as if the
2723 employee had taken the leave.
2824 (a-2) In establishing a leave pool under Subsection (a-1),
2925 the board of trustees of a school district shall adopt procedures
3026 for the administration and operation of the leave pool. The
3127 procedures must ensure that the number of days of personal leave
3228 that an employee is permitted to use from the leave pool is related
3329 to the number of personal days of leave contributed by the employee
3430 under Subsection (a-1).
3531 (c-1) Any informational handbook a school district provides
3632 to employees in an electronic or paper form or makes available by
3733 posting on the district website must include information on the
3834 leave pool created under Subsection (a-1) and notification of an
3935 employee's rights under Subsection (b) in the relevant section of
4036 the handbook. Any form used by a school district through which an
4137 employee may request leave under this section must include assault
4238 leave under Subsection (b) as an option.
4339 SECTION 2. This Act applies beginning with the 2021-2022
4440 school year.
4541 SECTION 3. This Act takes effect immediately if it receives
4642 a vote of two-thirds of all the members elected to each house, as
4743 provided by Section 39, Article III, Texas Constitution. If this
4844 Act does not receive the vote necessary for immediate effect, this
4945 Act takes effect September 1, 2021.
