6 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 11 | | SECTION 1. Section 2303.154, Occupations Code, is amended |
---|
8 | 12 | | by adding Subsection (h) to read as follows: |
---|
9 | 13 | | (h) A vehicle sold in compliance with this chapter shall be |
---|
10 | 14 | | titled and registered without the imposition by a county office of |
---|
11 | 15 | | additional requirements not otherwise permitted by law. |
---|
12 | 16 | | SECTION 2. Section 501.051, Transportation Code, is amended |
---|
13 | 17 | | by adding Subsection (d) to read as follows: |
---|
14 | 18 | | (d) The department shall place a hold on processing a title |
---|
15 | 19 | | application for a motor vehicle if the department receives a |
---|
16 | 20 | | request for a hold accompanied by evidence of a legal action |
---|
17 | 21 | | regarding ownership of or a lien interest in the motor vehicle. The |
---|
18 | 22 | | hold shall continue until a final, nonappealable judgment is |
---|
19 | 23 | | entered in the action or the party requesting the hold requests that |
---|
20 | 24 | | the hold be removed. |
---|
21 | 25 | | SECTION 3. Section 501.052, Transportation Code, is amended |
---|
22 | 26 | | by amending Subsection (e) and adding Subsection (f) to read as |
---|
23 | 27 | | follows: |
---|
24 | 28 | | (e) An applicant aggrieved by the determination under |
---|
25 | 29 | | Subsection (d) may appeal only to the county or district court of |
---|
26 | 30 | | the county of the applicant's residence. An applicant must file an |
---|
27 | 31 | | appeal not later than the fifth day after receipt [the date] of the |
---|
28 | 32 | | assessor-collector's determination. The judge shall try the |
---|
29 | 33 | | appeal in the manner of other civil cases. All rights and |
---|
30 | 34 | | immunities granted in the trial of a civil case are available to the |
---|
31 | 35 | | interested parties. If the department's action is not sustained, |
---|
32 | 36 | | the department shall promptly issue a title for the vehicle. |
---|
33 | 37 | | (f) A person may not apply for a hearing under this section |
---|
34 | 38 | | if the department's decision under Section 501.051 is related to a |
---|
35 | 39 | | title for a salvage motor vehicle or a nonrepairable motor vehicle, |
---|
36 | 40 | | as defined by Section 501.091. |
---|
37 | 41 | | SECTION 4. Section 501.053, Transportation Code, is amended |
---|
38 | 42 | | by adding Subsection (f) to read as follows: |
---|
39 | 43 | | (f) A person may not obtain a title under this section for a |
---|
40 | 44 | | salvage motor vehicle or a nonrepairable motor vehicle, as defined |
---|
41 | 45 | | by Section 501.091. |
---|
42 | 46 | | SECTION 5. This Act takes effect September 1, 2021. |
