| 7 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 12 | | SECTION 1. Chapter 242, Health and Safety Code, is amended |
|---|
| 9 | 13 | | by adding Subchapter T to read as follows: |
|---|
| 10 | 14 | | SUBCHAPTER T. SERVICES PROVIDED BY CERTAIN VOCATIONAL NURSING |
|---|
| 11 | 15 | | STUDENTS |
|---|
| 12 | 16 | | Sec. 242.951. DEFINITION. In this subchapter, "disaster" |
|---|
| 13 | 17 | | has the meaning assigned by Section 418.004, Government Code. |
|---|
| 14 | 18 | | Sec. 242.952. APPLICABILITY. This subchapter applies only |
|---|
| 15 | 19 | | to a student who is: |
|---|
| 16 | 20 | | (1) enrolled in an accredited school or program that |
|---|
| 17 | 21 | | is preparing the student for licensure as a licensed vocational |
|---|
| 18 | 22 | | nurse; and |
|---|
| 19 | 23 | | (2) participating in a clinical program at a facility |
|---|
| 20 | 24 | | licensed under this chapter. |
|---|
| 21 | 25 | | Sec. 242.953. SERVICES PROVIDED BY CERTAIN VOCATIONAL |
|---|
| 22 | 26 | | NURSING STUDENTS. (a) Notwithstanding any other law, services |
|---|
| 23 | 27 | | that are provided by a student to whom this subchapter applies in a |
|---|
| 24 | 28 | | facility licensed under this chapter and authorized by a contract |
|---|
| 25 | 29 | | or other arrangement with the facility are allowed at all times in |
|---|
| 26 | 30 | | this state, including during a declared state of disaster. |
|---|
| 27 | 31 | | (b) A facility licensed under this chapter may: |
|---|
| 28 | 32 | | (1) require a student to comply with the facility's |
|---|
| 29 | 33 | | policies regarding health screenings or the use of personal |
|---|
| 30 | 34 | | protective equipment; and |
|---|
| 31 | 35 | | (2) condition the student's provision of services on |
|---|
| 32 | 36 | | compliance with the facility's policies described by Subdivision |
|---|
| 33 | 37 | | (1). |
|---|
| 34 | 38 | | SECTION 2. This Act takes effect September 1, 2021. |
