55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study and pilot program to evaluate the provision of
88 prenatal and well child care in a group clinical setting and
99 authority to take related action.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.02493 to read as follows:
1313 Sec. 531.02493. CURRICULUM-BASED GROUP WELL CHILD CARE
1414 PILOT PROGRAM. (a) The commission shall develop and, not later
1515 than March 1, 2022, implement a pilot program to increase the rate
1616 at which recipients attend well child health care visits,
1717 developmental screenings, and immunizations by providing those
1818 services through a curriculum-based group well child care model in
1919 a clinical setting.
2020 (b) The commission shall operate the pilot program in one or
2121 more geographic areas of this state.
2222 (c) In implementing the pilot program, the commission
2323 shall:
2424 (1) require a Medicaid managed care organization to
2525 provide enhanced reimbursement in an amount determined by the
2626 commission to a health care provider for providing curriculum-based
2727 group well child care to recipients; and
2828 (2) evaluate whether the enhanced reimbursement
2929 increases the rate of children receiving well child visits,
3030 developmental screenings, and immunizations.
3131 (d) The commission shall operate the pilot program for two
3232 years.
3333 (e) Not later than September 1, 2024, the commission shall
3434 submit to the governor, the lieutenant governor, the speaker of the
3535 house of representatives, and each standing committee of the
3636 legislature having primary jurisdiction over health and human
3737 services a written report that:
3838 (1) summarizes the results of the pilot program; and
3939 (2) recommends whether the pilot program should
4040 continue, be expanded, or terminate or if the commission should
4141 permanently implement enhanced reimbursement to health care
4242 providers for providing curriculum-based group well child care in a
4343 clinical setting.
4444 (f) The executive commissioner may adopt rules as necessary
4545 to implement this section.
4646 (g) This section expires September 1, 2025.
4747 SECTION 2. (a) In this section:
4848 (1) "Commission" means the Health and Human Services
4949 Commission.
5050 (2) "Medicaid" means the medical assistance program
5151 established under Chapter 32, Human Resources Code.
5252 (3) "Medicaid managed care organization" means a
5353 managed care organization as defined by Section 533.001, Government
5454 Code, that contracts with the commission under Chapter 533,
5555 Government Code, to provide health care services to Medicaid
5656 recipients.
5757 (b) The commission shall conduct a study regarding the
5858 provision of curriculum-based prenatal care and curriculum-based
5959 well child care offered in a group clinical setting. The study
6060 must:
6161 (1) evaluate the health benefits and potential cost
6262 savings to Medicaid that would result from implementing
6363 curriculum-based group prenatal care models, including
6464 implementation of those models using virtual modalities similar to
6565 those used during the COVID-19 pandemic;
6666 (2) evaluate the use of procedure codes under Medicaid
6767 for curriculum-based group prenatal care in a clinical setting;
6868 (3) reassess the provider types authorized to provide
6969 prenatal benefits in a group clinical setting under Medicaid by
7070 identifying provider types that deliver curriculum-based group
7171 prenatal care, including federally qualified health centers,
7272 hospitals, rural health clinics, and individual health care
7373 providers; and
7474 (4) explore options for promoting curriculum-based
7575 group well child care models under Medicaid, including by:
7676 (A) assessing the need for establishing a
7777 procedure code under Medicaid for the provision of curriculum-based
7878 group well child care in a clinical setting; and
7979 (B) promoting value-based payment arrangements
8080 between providers and Medicaid managed care organizations.
8181 (c) Not later than September 1, 2022, the commission shall:
8282 (1) prepare and submit a report on the findings of the
8383 study conducted under Subsection (b) of this section to the
8484 standing committees of the senate and house of representatives
8585 having jurisdiction over Medicaid; and
8686 (2) based on the assessment under Subsection (b)(3) of
8787 this section, update the health care provider types that may
8888 provide prenatal benefits in a group clinical setting under
8989 Medicaid.
9090 (d) This section expires September 1, 2023.
9191 SECTION 3. If before implementing any provision of this Act
9292 a state agency determines that a waiver or authorization from a
9393 federal agency is necessary for implementation of that provision,
9494 the agency affected by the provision shall request the waiver or
9595 authorization and may delay implementing that provision until the
9696 waiver or authorization is granted.
9797 SECTION 4. This Act takes effect September 1, 2021.
