46 AN ACT
57 relating to the payment of certain employer contributions for
68 employed retirees of the Teacher Retirement System of Texas.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 825.4092, Government Code, is amended by
911 adding Subsection (f) to read as follows:
1012 (f) A reporting employer is ultimately responsible for
1113 payment of the amounts required to be contributed under Subsections
1214 (b) and (c). The employer may not directly or indirectly pass that
1315 cost on to the retiree through payroll deduction, by imposition of a
1416 fee, or by any other means designed to recover the cost.
1517 SECTION 2. The changes in law made by this Act apply to a
1618 retiree of the Teacher Retirement System of Texas regardless of
1719 whether the person retired from employment before, on, or after the
1820 effective date of this Act.
1921 SECTION 3. The changes in law made by this Act apply
2022 beginning with the 2021-2022 school year.
2123 SECTION 4. This Act takes effect immediately if it receives
2224 a vote of two-thirds of all the members elected to each house, as
2325 provided by Section 39, Article III, Texas Constitution. If this
2426 Act does not receive the vote necessary for immediate effect, this
2527 Act takes effect September 1, 2021.
