| 9 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 15 | | SECTION 1. Section 48.251(b), Human Resources Code, is |
|---|
| 11 | 16 | | amended to read as follows: |

| 12 | 17 | | (b) The executive commissioner by rule shall adopt |
|---|
| 13 | 18 | | definitions of "abuse," "neglect," "exploitation," and "an |
|---|
| 14 | 19 | | individual receiving services" for purposes of this subchapter and |
|---|
| 15 | 20 | | investigations conducted under this subchapter. The definition of |
|---|
| 16 | 21 | | "exploitation" adopted by the executive commissioner under this |
|---|
| 17 | 22 | | subsection may not exclude from the definition as an act of |
|---|
| 18 | 23 | | exploitation the provision of a monetary or property loan made to a |
|---|
| 19 | 24 | | provider by an individual receiving services from that provider. |
|---|
| 20 | 25 | | SECTION 2. This Act takes effect September 1, 2021. |
