9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 12.051(a), Utilities Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | (a) The commission is composed of five [three] | |
13 | 13 | commissioners appointed by the governor with the advice and consent | |
14 | 14 | of the senate, with: | |
15 | 15 | (1) three commissioners of the political party whose | |
16 | 16 | candidate for governor received the most votes in the most recent | |
17 | 17 | gubernatorial election; and | |
18 | 18 | (2) two commissioners of the political party whose | |
19 | 19 | candidate for governor received the second most votes in the most | |
20 | 20 | recent gubernatorial election. | |
21 | 21 | SECTION 2. The governor shall promptly appoint two | |
22 | 22 | commissioners to the Public Utility Commission of Texas in | |
23 | 23 | accordance with Section 12.051, Utilities Code, as amended by this | |
24 | 24 | Act. The governor shall designate one commissioner to a term that | |
25 | 25 | expires September 1, 2025, and one commissioner to a term that | |
26 | 26 | expires September 1, 2027. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
