46 AN ACT
57 relating to requiring the Texas Education Agency to provide
68 identification kits to school districts and open-enrollment
79 charter schools for distribution to the parent or legal custodian
810 of certain students.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter C, Chapter 33, Education Code, is
1113 amended by adding Section 33.0531 to read as follows:
1214 Sec. 33.0531. CHILD IDENTIFICATION PROGRAM. (a) The
1315 agency shall provide to all school districts and open-enrollment
1416 charter schools inkless, in-home fingerprint and DNA
1517 identification kits to be distributed through the district or
1618 school on request to the parent or legal custodian of any
1719 kindergarten, elementary, or middle school student.
1820 (b) A parent or legal custodian who receives a fingerprint
1921 and DNA identification kit may submit the kit to federal, state,
2022 tribal, or local law enforcement to help locate and return a missing
2123 or trafficked child.
2224 SECTION 2. Section 33.057, Education Code, is amended to
2325 read as follows:
2426 Sec. 33.057. DESTRUCTION OF FINGERPRINTS AND PHOTOGRAPHS.
2527 The agency shall adopt rules relating to the destruction of
2628 fingerprints and photographs made or kept under Section 33.053 or
2729 33.054 [this subchapter].
2830 SECTION 3. The Texas Education Agency is required to
2931 implement Section 33.0531, Education Code, as added by this Act,
3032 only if the legislature appropriates money specifically for that
3133 purpose. If the legislature does not appropriate money
3234 specifically for that purpose, the agency may, but is not required
3335 to, implement that section using other appropriations available for
3436 that purpose.
3537 SECTION 4. This Act takes effect September 1, 2021.
