9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 12 | | SECTION 1. Subchapter C, Chapter 33, Education Code, is |
---|
11 | 13 | | amended by adding Section 33.0531 to read as follows: |
---|
12 | 14 | | Sec. 33.0531. CHILD IDENTIFICATION PROGRAM. (a) The |
---|
13 | 15 | | agency shall provide to all school districts and open-enrollment |
---|
14 | 16 | | charter schools inkless, in-home fingerprint and DNA |
---|
15 | 17 | | identification kits to be distributed through the district or |
---|
16 | 18 | | school on request to the parent or legal custodian of any |
---|
17 | 19 | | kindergarten, elementary, or middle school student. |
---|
18 | 20 | | (b) A parent or legal custodian who receives a fingerprint |
---|
19 | 21 | | and DNA identification kit may submit the kit to federal, state, |
---|
20 | 22 | | tribal, or local law enforcement to help locate and return a missing |
---|
21 | 23 | | or trafficked child. |
---|
22 | 24 | | SECTION 2. Section 33.057, Education Code, is amended to |
---|
23 | 25 | | read as follows: |

24 | 26 | | Sec. 33.057. DESTRUCTION OF FINGERPRINTS AND PHOTOGRAPHS. |
---|
25 | 27 | | The agency shall adopt rules relating to the destruction of |
---|
26 | 28 | | fingerprints and photographs made or kept under Section 33.053 or |
---|
27 | 29 | | 33.054 [this subchapter]. |
---|
28 | 30 | | SECTION 3. The Texas Education Agency is required to |
---|
29 | 31 | | implement Section 33.0531, Education Code, as added by this Act, |
---|
30 | 32 | | only if the legislature appropriates money specifically for that |
---|
31 | 33 | | purpose. If the legislature does not appropriate money |
---|
32 | 34 | | specifically for that purpose, the agency may, but is not required |
---|
33 | 35 | | to, implement that section using other appropriations available for |
---|
34 | 36 | | that purpose. |
---|
35 | 37 | | SECTION 4. This Act takes effect September 1, 2021. |
