| 8 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 8 | | SECTION 1. Section 2205.036(c), Government Code, is amended |
|---|
| 10 | 9 | | to read as follows: |
|---|
| 11 | 10 | | (c) The department may not provide aircraft transportation |
|---|
| 12 | 11 | | to a destination unless: |
|---|
| 13 | 12 | | (1) the destination is not served by a commercial |
|---|
| 14 | 13 | | carrier; |
|---|
| 15 | 14 | | (2) the aircraft transportation is the most |
|---|
| 16 | 15 | | cost-effective travel arrangement in accordance with Section |
|---|
| 17 | 16 | | 660.007(a); |
|---|
| 18 | 17 | | (3) the time required to use a commercial carrier |
|---|
| 19 | 18 | | interferes with passenger obligations; |
|---|
| 20 | 19 | | (4) a representative of the Department of Public |
|---|
| 21 | 20 | | Safety determines that security concerns for a passenger warrant |
|---|
| 22 | 21 | | the use of a state aircraft; |
|---|
| 23 | 22 | | (5) the number of passengers traveling makes the use |
|---|
| 24 | 23 | | of a state aircraft cost-effective; or |
|---|
| 25 | 24 | | (6) [(4)] emergency circumstances necessitate the use |
|---|
| 26 | 25 | | of a state aircraft. |
|---|
| 27 | 26 | | SECTION 2. This Act takes effect September 1, 2021. |
