65 AN ACT
76 relating to the completion of sexual harassment prevention training
87 and ethics training to register as a lobbyist.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 305.005(f), Government Code, is amended
1110 to read as follows:
1211 (f) The registration must be written and verified and must
1312 contain:
1413 (1) the registrant's full name and address;
1514 (2) the registrant's normal business, business phone
1615 number, and business address;
1716 (3) the full name and address of each person:
1817 (A) who reimburses, retains, or employs the
1918 registrant to communicate directly with a member of the legislative
2019 or executive branch to influence legislation or administrative
2120 action; and
2221 (B) on whose behalf the registrant has
2322 communicated directly with a member of the legislative or executive
2423 branch to influence legislation or administrative action;
2524 (4) the subject matter of the legislation or of the
2625 administrative action that is the subject of the registrant's
2726 direct communication with a member of the legislative or executive
2827 branch and, if applicable, the docket number or other
2928 administrative designation of the administrative action;
3029 (5) for each person employed or retained by the
3130 registrant for the purpose of assisting in direct communication
3231 with a member of the legislative or executive branch to influence
3332 legislation or administrative action:
3433 (A) the full name, business address, and
3534 occupation of the person; and
3635 (B) the subject matter of the legislation or of
3736 the administrative action to which the person's activities
3837 reportable under this section were related and, if applicable, the
3938 docket number or other administrative designation of the
4039 administrative action; [and]
4140 (6) the amount of compensation or reimbursement paid
4241 by each person who reimburses, retains, or employs the registrant
4342 for the purpose of communicating directly with a member of the
4443 legislative or executive branch or on whose behalf the registrant
4544 communicates directly with a member of the legislative or executive
4645 branch;
4746 (7) a certificate evidencing completion of a sexual
4847 harassment prevention training course in the previous two years, as
4948 required by Section 305.0052; and
5049 (8) a certificate evidencing completion of an ethics
5150 training course in the previous two years, as required by Section
5251 305.0053.
5352 SECTION 2. Subchapter A, Chapter 305, Government Code, is
5453 amended by adding Sections 305.0052 and 305.0053 to read as
5554 follows:
5655 Sec. 305.0052. SEXUAL HARASSMENT PREVENTION TRAINING. (a)
5756 Each individual required to register under this chapter shall
5857 attend a sexual harassment prevention training course every two
5958 years, as approved by the commission, and shall submit to the
6059 commission a certificate of completion of the course.
6160 (b) The certificate of completion must be in a form approved
6261 by the commission.
6362 (c) The commission shall adopt rules as necessary to
6463 implement this section.
6564 Sec. 305.0053. ETHICS TRAINING. (a) Each individual
6665 required to register under this chapter shall attend an ethics
6766 training course every two years, as approved by the commission, and
6867 shall submit to the commission a certificate of completion of the
6968 course.
7069 (b) The certificate of completion must be in a form approved
7170 by the commission.
7271 (c) The commission shall adopt rules as necessary to
7372 implement this section.
7473 SECTION 3. Not later than December 1, 2021, the Texas Ethics
7574 Commission shall adopt rules as required by Sections 305.0052 and
7675 305.0053, Government Code, as added by this Act.
7776 SECTION 4. Section 305.005, Government Code, as amended by
7877 this Act, applies only to a registration required to be filed under
7978 that section on or after January 1, 2022.
8079 SECTION 5. This Act takes effect September 1, 2021.
