49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the inclusion of local school health advisory councils
712 as governmental bodies for purposes of the open meetings law and the
813 public information law.
914 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. Section 551.001(3), Government Code, is amended
1116 to read as follows:
1217 (3) "Governmental body" means:
1318 (A) a board, commission, department, committee,
1419 or agency within the executive or legislative branch of state
1520 government that is directed by one or more elected or appointed
1621 members;
1722 (B) a county commissioners court in the state;
1823 (C) a municipal governing body in the state;
1924 (D) a deliberative body that has rulemaking or
2025 quasi-judicial power and that is classified as a department,
2126 agency, or political subdivision of a county or municipality;
2227 (E) a school district board of trustees;
2328 (F) a county board of school trustees;
2429 (G) a county board of education;
2530 (H) the governing board of a special district
2631 created by law;
2732 (I) a local workforce development board created
2833 under Section 2308.253;
2934 (J) a nonprofit corporation that is eligible to
3035 receive funds under the federal community services block grant
3136 program and that is authorized by this state to serve a geographic
3237 area of the state;
3338 (K) a nonprofit corporation organized under
3439 Chapter 67, Water Code, that provides a water supply or wastewater
3540 service, or both, and is exempt from ad valorem taxation under
3641 Section 11.30, Tax Code; [and]
3742 (L) a joint board created under Section 22.074,
3843 Transportation Code; and
3944 (M) a local school health advisory council
4045 established under Section 28.004, Education Code.
4146 SECTION 2. Section 552.003(1), Government Code, is amended
4247 to read as follows:
4348 (1) "Governmental body":
4449 (A) means:
4550 (i) a board, commission, department,
4651 committee, institution, agency, or office that is within or is
4752 created by the executive or legislative branch of state government
4853 and that is directed by one or more elected or appointed members;
4954 (ii) a county commissioners court in the
5055 state;
5156 (iii) a municipal governing body in the
5257 state;
5358 (iv) a deliberative body that has
5459 rulemaking or quasi-judicial power and that is classified as a
5560 department, agency, or political subdivision of a county or
5661 municipality;
5762 (v) a school district board of trustees;
5863 (vi) a county board of school trustees;
5964 (vii) a county board of education;
6065 (viii) the governing board of a special
6166 district;
6267 (ix) the governing body of a nonprofit
6368 corporation organized under Chapter 67, Water Code, that provides a
6469 water supply or wastewater service, or both, and is exempt from ad
6570 valorem taxation under Section 11.30, Tax Code;
6671 (x) a local workforce development board
6772 created under Section 2308.253;
6873 (xi) a nonprofit corporation that is
6974 eligible to receive funds under the federal community services
7075 block grant program and that is authorized by this state to serve a
7176 geographic area of the state;
7277 (xii) a confinement facility operated under
7378 a contract with any division of the Texas Department of Criminal
7479 Justice;
7580 (xiii) a civil commitment housing facility
7681 owned, leased, or operated by a vendor under contract with the state
7782 as provided by Chapter 841, Health and Safety Code;
7883 (xiv) an entity that receives public funds
7984 in the current or preceding state fiscal year to manage the daily
8085 operations or restoration of the Alamo, or an entity that oversees
8186 such an entity; [and]
8287 (xv) the part, section, or portion of an
8388 organization, corporation, commission, committee, institution, or
8489 agency that spends or that is supported in whole or in part by
8590 public funds; and
8691 (xvi) a local school health advisory
8792 council established under Section 28.004, Education Code; and
8893 (B) does not include:
8994 (i) the judiciary; or
9095 (ii) an economic development entity whose
9196 mission or purpose is to develop and promote the economic growth of
9297 a state agency or political subdivision with which the entity
9398 contracts if:
9499 (a) the entity does not receive $1
95100 million or more in public funds from a single state agency or
96101 political subdivision in the current or preceding state fiscal
97102 year; or
98103 (b) the entity:
99104 (1) either:
100105 (A) does not have the
101106 authority to make decisions or recommendations on behalf of a state
102107 agency or political subdivision regarding tax abatements or tax
103108 incentives; or
104109 (B) does not require an
105110 officer of the state agency or political subdivision to hold office
106111 as a member of the board of directors of the entity;
107112 (2) does not use staff or office
108113 space of the state agency or political subdivision for no or nominal
109114 consideration, unless the space is available to the public;
110115 (3) to a reasonable degree,
111116 tracks the entity's receipt and expenditure of public funds
112117 separately from the entity's receipt and expenditure of private
113118 funds; and
114119 (4) provides at least quarterly
115120 public reports to the state agency or political subdivision
116121 regarding work performed on behalf of the state agency or political
117122 subdivision.
118123 SECTION 3. (a) The changes in law made by this Act apply
119124 only to a meeting held on or after the effective date of this Act. A
120125 meeting held before the effective date of this Act is governed by
121126 the law in effect immediately before the effective date of this Act,
122127 and the former law is continued in effect for that purpose.
123128 (b) The changes in law made by this Act apply only to a
124129 request for public information received on or after the effective
125130 date of this Act. A request for public information received before
126131 the effective date of this Act is governed by the law in effect when
127132 the request was received, and the former law is continued in effect
128133 for that purpose.
129134 SECTION 4. This Act takes effect September 1, 2021.
