|---|
| 15 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 12 | | SECTION 1. Subchapter C, Chapter 281, Health and Safety |
|---|
| 17 | 13 | | Code, is amended by adding Section 281.0519 to read as follows: |
|---|
| 18 | 14 | | Sec. 281.0519. TARRANT COUNTY HOSPITAL DISTRICT; AUTHORITY |
|---|
| 19 | 15 | | TO SELL OR LICENSE INTELLECTUAL PROPERTY. (a) The Tarrant County |
|---|
| 20 | 16 | | Hospital District or a nonprofit corporation formed by the district |
|---|
| 21 | 17 | | may: |
|---|
| 22 | 18 | | (1) sell or license technology or intellectual |
|---|
| 23 | 19 | | property that is owned by or licensed to the district or a nonprofit |
|---|
| 24 | 20 | | corporation formed by the district; |
|---|
| 25 | 21 | | (2) enter into a contract to provide services related |
|---|
| 26 | 22 | | to technology or intellectual property sold or licensed under |
|---|
| 27 | 23 | | Subdivision (1); |
|---|
| 28 | 24 | | (3) contract, collaborate, or enter into a joint |
|---|
| 29 | 25 | | venture or other agreement with a public or private entity to engage |
|---|
| 30 | 26 | | in an activity authorized under Subdivision (1) or (2); or |
|---|
| 31 | 27 | | (4) take any other action necessary to protect or |
|---|
| 32 | 28 | | benefit from the exclusivity of technology and intellectual |
|---|
| 33 | 29 | | property owned by or licensed to the district or a nonprofit |
|---|
| 34 | 30 | | corporation formed by the district, including applying for, |
|---|
| 35 | 31 | | acquiring, registering, securing, holding, protecting, and |
|---|
| 36 | 32 | | renewing under applicable provisions of state, federal, or |
|---|
| 37 | 33 | | international law: |
|---|
| 38 | 34 | | (A) a patent; |
|---|
| 39 | 35 | | (B) a copyright; |
|---|
| 40 | 36 | | (C) a trademark, service mark, collective mark, |
|---|
| 41 | 37 | | or certification mark; or |
|---|
| 42 | 38 | | (D) any other form of protection of intellectual |
|---|
| 43 | 39 | | property provided by law. |
|---|
| 44 | 40 | | (b) For purposes of Subsection (a)(3): |
|---|
| 45 | 41 | | (1) a public or private entity may be a for-profit or a |
|---|
| 46 | 42 | | nonprofit entity; and |
|---|
| 47 | 43 | | (2) a nonprofit corporation formed by the district may |
|---|
| 48 | 44 | | hold an ownership interest in a public or private entity described |
|---|
| 49 | 45 | | by Subsection (a)(3). |
|---|
| 50 | 46 | | (c) Information prepared or compiled by or for the Tarrant |
|---|
| 51 | 47 | | County Hospital District or a nonprofit corporation formed by the |
|---|
| 52 | 48 | | district relating to the development of technology or intellectual |
|---|
| 53 | 49 | | property to which this section applies is exempt from public |
|---|
| 54 | 50 | | disclosure under Chapter 552, Government Code. |
|---|
| 55 | 51 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 56 | 52 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 57 | 53 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 58 | 54 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 59 | 55 | | Act takes effect September 1, 2021. |
