106 AN ACT
117 relating to the authority of the Tarrant County Hospital District
128 or a nonprofit corporation formed by the district regarding certain
139 technology or intellectual property owned by or licensed to the
1410 district or corporation.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. Subchapter C, Chapter 281, Health and Safety
1713 Code, is amended by adding Section 281.0519 to read as follows:
1814 Sec. 281.0519. TARRANT COUNTY HOSPITAL DISTRICT; AUTHORITY
1915 TO SELL OR LICENSE INTELLECTUAL PROPERTY. (a) The Tarrant County
2016 Hospital District or a nonprofit corporation formed by the district
2117 may:
2218 (1) sell or license technology or intellectual
2319 property that is owned by or licensed to the district or a nonprofit
2420 corporation formed by the district;
2521 (2) enter into a contract to provide services related
2622 to technology or intellectual property sold or licensed under
2723 Subdivision (1);
2824 (3) contract, collaborate, or enter into a joint
2925 venture or other agreement with a public or private entity to engage
3026 in an activity authorized under Subdivision (1) or (2); or
3127 (4) take any other action necessary to protect or
3228 benefit from the exclusivity of technology and intellectual
3329 property owned by or licensed to the district or a nonprofit
3430 corporation formed by the district, including applying for,
3531 acquiring, registering, securing, holding, protecting, and
3632 renewing under applicable provisions of state, federal, or
3733 international law:
3834 (A) a patent;
3935 (B) a copyright;
4036 (C) a trademark, service mark, collective mark,
4137 or certification mark; or
4238 (D) any other form of protection of intellectual
4339 property provided by law.
4440 (b) For purposes of Subsection (a)(3):
4541 (1) a public or private entity may be a for-profit or a
4642 nonprofit entity; and
4743 (2) a nonprofit corporation formed by the district may
4844 hold an ownership interest in a public or private entity described
4945 by Subsection (a)(3).
5046 (c) Information prepared or compiled by or for the Tarrant
5147 County Hospital District or a nonprofit corporation formed by the
5248 district relating to the development of technology or intellectual
5349 property to which this section applies is exempt from public
5450 disclosure under Chapter 552, Government Code.
5551 SECTION 2. This Act takes effect immediately if it receives
5652 a vote of two-thirds of all the members elected to each house, as
5753 provided by Section 39, Article III, Texas Constitution. If this
5854 Act does not receive the vote necessary for immediate effect, this
5955 Act takes effect September 1, 2021.
