55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to disclosure to legislators of certain attorney grievance
88 information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 81.0885, Government Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) All types of information, proceedings, hearing
1414 transcripts, and statements presented to the ombudsman are
1515 confidential and may not be disclosed to any person other than the
1616 chief disciplinary counsel unless:
1717 (1) disclosure is ordered by a court; or
1818 (2) a member of the legislature requests disclosure
1919 and the complainant consents to disclosure.
2020 (c) A member of the legislature to whom information,
2121 proceedings, hearing transcripts, or statements presented to the
2222 ombudsman are disclosed under Subsection (a) may use the
2323 information, proceedings, hearing transcripts, or statements only
2424 in the performance of a power or duty associated with the member's
2525 office.
2626 SECTION 2. Section 81.0885, Government Code, as amended by
2727 this Act, applies only to a disclosure of information, proceedings,
2828 hearing transcripts, and statements presented to the ombudsman for
2929 the attorney discipline system of the State Bar of Texas that occurs
3030 on or after the effective date of this Act.
3131 SECTION 3. This Act takes effect September 1, 2021.
