| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 81.0885, Government Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) All types of information, proceedings, hearing |
|---|
| 14 | 14 | | transcripts, and statements presented to the ombudsman are |
|---|
| 15 | 15 | | confidential and may not be disclosed to any person other than the |
|---|
| 16 | 16 | | chief disciplinary counsel unless: |
|---|
| 17 | 17 | | (1) disclosure is ordered by a court; or |
|---|
| 18 | 18 | | (2) a member of the legislature requests disclosure |
|---|
| 19 | 19 | | and the complainant consents to disclosure. |

| 20 | 20 | | (c) A member of the legislature to whom information, |
|---|
| 21 | 21 | | proceedings, hearing transcripts, or statements presented to the |
|---|
| 22 | 22 | | ombudsman are disclosed under Subsection (a) may use the |
|---|
| 23 | 23 | | information, proceedings, hearing transcripts, or statements only |
|---|
| 24 | 24 | | in the performance of a power or duty associated with the member's |
|---|
| 25 | 25 | | office. |

| 26 | 26 | | SECTION 2. Section 81.0885, Government Code, as amended by |
|---|
| 27 | 27 | | this Act, applies only to a disclosure of information, proceedings, |
|---|
| 28 | 28 | | hearing transcripts, and statements presented to the ombudsman for |
|---|
| 29 | 29 | | the attorney discipline system of the State Bar of Texas that occurs |
|---|
| 30 | 30 | | on or after the effective date of this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2021. |
