59 relating to prevention and early intervention programs and
610 practices.
711 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
812 SECTION 1. Section 264.201(d), Family Code, is amended to
913 read as follows:
1014 (d) The services may include in-home programs, parenting
1115 skills training, youth coping skills, and individual and family
1216 counseling. If the department requires or a court orders parenting
1317 skills training services through a parenting education program or
1418 practice, the program or practice must be an evidence-based program
1519 or practice or promising [practice parenting education] program or
1620 practice [described by Section 265.151] that is provided in the
1721 community in which the family resides, if available.
1822 SECTION 2. Section 265.004(a-1), Family Code, is amended to
1923 read as follows:
2024 (a-1) The department shall ensure that not less than 75
2125 percent of the money appropriated for parenting education programs
2226 under Subsection (a) funds evidence-based programs or practices
2327 described by Section 265.151(b) and that the remainder of that
2428 money funds promising [practice] programs or practices described by
2529 Section 265.151(c) or evidence-informed programs or practices
2630 described by Section 265.151(d).
2731 SECTION 3. The heading to Subchapter D, Chapter 265, Family
2832 Code, is amended to read as follows:

3135 SECTION 4. The heading to Section 265.151, Family Code, is
3236 amended to read as follows:
3337 Sec. 265.151. REQUIREMENTS FOR [PARENTING EDUCATION]
3438 PROGRAMS AND PRACTICES ON EVIDENCE-BASED SPECTRUM.
3539 SECTION 5. Section 265.151, Family Code, is amended by
3640 amending Subsections (b) and (c) and adding Subsection (d) to read
3741 as follows:
3842 (b) An evidence-based program or practice is a [parenting
3943 education] program or practice that:
4044 (1) is research-based and grounded in relevant,
4145 empirical knowledge and program-determined outcomes;
4246 (2) has comprehensive standards ensuring the highest
4347 quality service delivery with continuous improvement in the quality
4448 of service delivery;
4549 (3) has demonstrated significant positive [short-term
4650 and long-term] outcomes;
4751 (4) has been evaluated by at least one rigorous,
4852 random, controlled research trial across heterogeneous populations
4953 or communities with research results that have been published in a
5054 peer-reviewed journal;
5155 (5) substantially complies with a program or practice
5256 manual or design that specifies the purpose, outcomes, duration,
5357 and frequency of the program or practice services; [and]
5458 (6) employs well-trained and competent staff and
5559 provides continual relevant professional development opportunities
5660 to the staff; and
5761 (7) is associated with an organization in this state,
5862 a national organization, an institution of higher education, or a
5963 national or state public health institute.
6064 (c) A promising [practice] program or practice is a
6165 [parenting education] program or practice that:
6266 (1) has an active impact evaluation of the program or
6367 practice or demonstrates a schedule for implementing an active
6468 impact evaluation of the program or practice;
6569 (2) has been evaluated by at least one outcome-based
6670 study demonstrating effectiveness or random, controlled trial in a
6771 homogeneous sample;
6872 (3) substantially complies with a program or practice
6973 manual or design that specifies the purpose, outcomes, duration,
7074 and frequency of the program or practice services;
7175 (4) employs well-trained and competent staff and
7276 provides continual relevant professional development opportunities
7377 to the staff; and
7478 (5) is research-based and grounded in relevant,
7579 empirical knowledge and program- or practice-determined
7680 [program-determined] outcomes.
7781 (d) An evidence-informed program or practice is a program or
7882 practice that:
7983 (1) combines well-researched interventions with
8084 clinical experience and ethics, and client preferences and culture,
8185 to guide and inform the delivery of treatments and services;
8286 (2) has an active impact evaluation of the program or
8387 practice or demonstrates a schedule for implementing an active
8488 impact evaluation of the program or practice;
8589 (3) substantially complies with a program or practice
8690 manual or design that specifies the purpose, outcome, duration, and
8791 frequency of the program or practice services; and
8892 (4) employs well-trained and competent staff and
8993 provides continual relevant professional development opportunities
9094 to the staff.
9195 SECTION 6. Section 265.152, Family Code, is amended to read
9296 as follows:
9397 Sec. 265.152. OUTCOMES OF EVIDENCE-BASED PREVENTION AND
9498 EARLY INTERVENTION PROGRAMS AND PRACTICES [PARENTING EDUCATION].
9599 The department shall ensure that a prevention and early
96100 intervention [parenting education] program or practice provided
97101 under this subchapter [chapter] achieves favorable behavioral
98102 outcomes in at least two of the following areas:
99103 (1) improved cognitive development of children;
100104 (2) increased [school] readiness for and
101105 participation and performance in school [of children];
102106 (3) reduced child abuse, neglect, and injury;
103107 (4) improved child safety;
104108 (5) improved social-emotional development of children
105109 and youth;
106110 (6) increased protective factors [improved parenting
107111 skills], including nurturing, [and] bonding, and other parenting
108112 skills;
109113 (7) improved family economic self-sufficiency;
110114 (8) reduced parental or youth involvement with the
111115 criminal justice system; and
112116 (9) increased paternal involvement and support.
113117 SECTION 7. Section 265.153, Family Code, is amended to read
114118 as follows:
115119 Sec. 265.153. EVALUATION OF PREVENTION AND EARLY
116120 INTERVENTION PROGRAMS AND PRACTICES [EVIDENCE-BASED PARENTING
117121 EDUCATION]. (a) The department shall adopt outcome indicators to
118122 measure the effectiveness of prevention and early intervention
119123 [parenting education] programs and practices provided under this
120124 subchapter [chapter] in achieving desired outcomes.
121125 (b) The department may work directly with the model
122126 developer of a prevention and early intervention [parenting
123127 education] program or practice to identify appropriate outcome
124128 indicators for the program or practice and to ensure that the
125129 program or practice substantially complies with the model.
126130 (c) The department shall develop internal processes to
127131 share information with prevention and early intervention service
128132 providers [parenting education programs] to assist the department
129133 in analyzing the performance of the programs or practices.
130134 (d) The department shall use information obtained under
131135 this section to:
132136 (1) monitor prevention and early intervention
133137 [parenting education] programs and practices;
134138 (2) continually improve the quality of the programs
135139 and practices; and
136140 (3) evaluate the effectiveness of the programs and
137141 practices.
138142 SECTION 8. Section 265.154, Family Code, is amended to read
139143 as follows:
140144 Sec. 265.154. REPORTS TO LEGISLATURE. (a) Not later than
141145 December 1 of each even-numbered year, the department shall prepare
142146 and submit a report on state-funded prevention and early
143147 intervention [parenting education] programs and practices to the
144148 standing committees of the senate and house of representatives with
145149 jurisdiction over child protective services.
146150 (b) A report submitted under this section must include:
147151 (1) a description of the prevention and early
148152 intervention [parenting education] programs and practices
149153 implemented and of the models associated with the programs and
150154 practices;
151155 (2) information on the families served by the programs
152156 and practices, including the number of families served and their
153157 demographic information;
154158 (3) the goals and achieved outcomes of the implemented
155159 programs and practices;
156160 (4) information on the cost for each family served,
157161 including any available third-party return-on-investment analysis;
158162 and
159163 (5) information explaining the percentage of money
160164 spent on evidence-based programs and practices, on promising
161165 [practice] programs and practices, and on evidence-informed
162166 programs and practices.
163167 SECTION 9. Section 265.151(a), Family Code, is repealed.
164168 SECTION 10. This Act takes effect September 1, 2021.
