85 AN ACT
96 relating to the requirements for meetings held and Internet
107 websites developed by certain special purpose districts.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 403.0241(c), Government Code, is amended
1310 to read as follows:
1411 (c) For each special purpose district described by
1512 Subsection (b), the database must include:
1613 (1) the name of the special purpose district;
1714 (2) the name of each board member of the special
1815 purpose district;
1916 (3) contact information for the main office of the
2017 special purpose district, including the physical address, the
2118 mailing address, and the main telephone number;
2219 (4) if the special purpose district employs a person
2320 as a general manager or executive director, or in another position
2421 to perform duties or functions comparable to those of a general
2522 manager or executive director, the name of the employee;
2623 (5) if the special purpose district contracts with a
2724 utility operator, contact information for a person representing the
2825 utility operator, including a mailing address and a telephone
2926 number;
3027 (6) if the special purpose district contracts with a
3128 tax assessor-collector, contact information for a person
3229 representing the tax assessor-collector, including a mailing
3330 address and telephone number;
3431 (7) the special purpose district's Internet website
3532 address or, if the district does not maintain an Internet website,
3633 the address of any Internet website or websites the district uses to
3734 comply with Section 2051.202 of this code and Section 26.18, Tax
3835 Code[, if any];
3936 (8) the financial information described by Section
4037 140.008(b) or (g), Local Government Code, including any revenue
4138 obligations;
4239 (9) the total amount of bonds authorized by the voters
4340 of the special purpose district that are payable wholly or partly
4441 from ad valorem taxes, excluding refunding bonds if refunding bonds
4542 were separately authorized and excluding contract revenue bonds;
4643 (10) the aggregate initial principal amount of all
4744 bonds issued by the special purpose district that are payable
4845 wholly or partly from ad valorem taxes, excluding refunding bonds
4946 and contract revenue bonds;
5047 (11) the rate of any sales and use tax the special
5148 purpose district imposes;
5249 (12) for a special purpose district that imposes an ad
5350 valorem tax:
5451 (A) the ad valorem tax rate for the most recent
5552 tax year if the district is a district as defined by Section 49.001,
5653 Water Code; or
5754 (B) the table of ad valorem tax rates for the most
5855 recent tax year described by Section 26.16, Tax Code, in the form
5956 required by that section, if the district is not a district as
6057 defined by Section 49.001, Water Code; and
6158 (13) a link to the Internet website described by
6259 Section 49.062(g), Water Code, with a plain-language description of
6360 how a resident may petition to require that board meetings of
6461 certain special purpose districts be held not further than 10 miles
6562 from the boundary of the district.
6663 SECTION 2. Section 551.1283, Government Code, is amended by
6764 adding Subsections (d) and (e) to read as follows:
6865 (d) A district that maintains an Internet website shall post
6966 on that website links to any other Internet website or websites the
7067 district uses to comply with Section 2051.202 of this code and
7168 Section 26.18, Tax Code.
7269 (e) Nothing in this chapter shall prohibit a district from
7370 allowing a person to watch or listen to a board meeting by video or
7471 telephone conference call.
7572 SECTION 3. Subchapter E, Chapter 2051, Government Code, as
7673 added by Chapter 1029 (H.B. 305), Acts of the 86th Legislature,
7774 Regular Session, 2019, is redesignated as Subchapter F, Chapter
7875 2051, Government Code, and amended to read as follows:
7976 SUBCHAPTER F [E]. INTERNET WEBSITE
8077 Sec. 2051.201 [2051.151]. [APPLICABILITY OF SUBCHAPTER.
8178 Except as provided by Section 2051.152(b), this subchapter applies
8279 only to a political subdivision with the authority to impose a tax
8380 that at any time on or after January 1, 2019, maintained a publicly
8481 accessible Internet website.
8582 [Sec. 2051.152.] INFORMATION REQUIRED ON WEBSITE. (a) This
8683 section applies only to a political subdivision with the authority
8784 to impose a tax that:
8885 (1) at any time on or after January 1, 2019, maintained
8986 a publicly accessible Internet website; and
9087 (2) is not subject to Section 2051.202.
9188 (b) A political subdivision to which this section applies
9289 shall post on a publicly accessible Internet website the following
9390 information:
9491 (1) the political subdivision's contact information,
9592 including a mailing address, telephone number, and e-mail address;
9693 (2) each elected officer of the political subdivision;
9794 (3) the date and location of the next election for
9895 officers of the political subdivision;
9996 (4) the requirements and deadline for filing for
10097 candidacy of each elected office of the political subdivision,
10198 which shall be continuously posted for at least one year before the
10299 election day for the office;
103100 (5) each notice of a meeting of the political
104101 subdivision's governing body under Subchapter C, Chapter 551; and
105102 (6) each record of a meeting of the political
106103 subdivision's governing body under Section 551.021.
107104 (c) [(b)] Subsections (b)(5) [(a)(5)] and (6) do not apply
108105 to:
109106 (1) a county with a population of less than 10,000;
110107 (2) a municipality with a population of less than
111108 5,000 located in a county with a population of less than 25,000; or
112109 (3) a school district with a population of less than
113110 5,000 in the district's boundaries and located in a county with a
114111 population of less than 25,000.
115112 Sec. 2051.202. FINANCIAL AND OPERATING INFORMATION OF
116113 SPECIAL PURPOSE DISTRICTS. (a) In this section, "special purpose
117114 district" means a political subdivision of this state with
118115 geographic boundaries that define the subdivision's territorial
119116 jurisdiction. The term does not include a municipality, county,
120- junior college district, independent school district, groundwater
121- conservation district, river authority, or political subdivision
122- with statewide jurisdiction.

123119 (b) This section applies only to a special purpose district
124120 that:
125121 (1) is authorized by the state by a general or special
126122 law to impose an ad valorem tax;
127123 (2) during the most recent fiscal year imposed an ad
128124 valorem tax;
129125 (3) during the most recent fiscal year:
130126 (A) had bonds outstanding;
131127 (B) had gross receipts from operations, loans,
132128 taxes, or contributions in excess of $250,000; or
133129 (C) had cash and temporary investments in excess
134130 of $250,000; and
135131 (4) at the beginning of the most recent fiscal year,
136132 had a population of 500 or more, as determined by the governing body
137133 of the special purpose district.
138134 (c) Notwithstanding Subsections (a) and (b), this section
139135 applies to a district created and operating under Chapter 387,
140136 Local Government Code.
141137 (d) A special purpose district shall post or cause to be
142138 posted on an Internet website the following information, if
143139 applicable:
144140 (1) the name of the special purpose district;
145141 (2) the name and term of office of each member of the
146142 governing body of the special purpose district;
147143 (3) the contact information for the main office of the
148144 special purpose district, including the physical address, the
149145 mailing address, and the telephone number;
150146 (4) the official contact information for each member
151147 of the governing body of the special purpose district;
152148 (5) if the special purpose district employs a person
153149 as a general manager or executive director, or in another position
154150 to perform duties or functions comparable to those of a general
155151 manager or executive director, the name of the general manager,
156152 executive director, or person that performs those duties;
157153 (6) if the special purpose district contracts with a
158154 utility operator, the contact information for a person representing
159155 the utility operator, including a mailing address and telephone
160156 number;
161157 (7) if the special purpose district contracts with a
162158 tax assessor-collector, the contact information for a person
163159 representing the tax assessor-collector, including a mailing
164160 address and telephone number;
165161 (8) if the special purpose district imposes an ad
166162 valorem tax, the rate of the ad valorem tax of the special purpose
167163 district;
168164 (9) if the special purpose district imposes a sales
169165 and use tax, the rate of the sales and use tax of the special purpose
170166 district;
171167 (10) any notice of tax hearing required to be given
172168 under Chapter 26, Tax Code, or Section 49.236, Water Code;
173169 (11) the location and schedule of meetings of the
174170 governing body of the special purpose district;
175171 (12) a statement substantially similar to the
176172 following: “Residents of the district have the right to request the
177173 designation of a meeting location within the district under Section
178- 49.062(g), Water Code. A description of this process can be found at
179- (insert link to the Internet website described by Section
174+ 49.062(g), Water Code. A description of this process can be found
175+ at (insert link to the Internet website described by Section
180176 49.062(g), Water Code).”;
181177 (13) each notice of a meeting of the governing body of
182178 the special purpose district under Subchapter C, Chapter 551, for
183179 meetings conducted in the current calendar year and the immediately
184180 preceding calendar year;
185181 (14) the minutes of a public meeting of the governing
186182 body of the special purpose district under Section 551.021 for
187183 meetings conducted in the current calendar year and the immediately
188184 preceding calendar year; and
189185 (15) the most recent financial audit of the special
190186 purpose district.
191187 SECTION 4. Section 49.062, Water Code, is amended by
192188 amending Subsection (b) and adding Subsection (b-1) to read as
193189 follows:
194190 (b) Except as provided by Subsection (b-1), the [The] board
195191 shall designate one or more places inside or outside the district
196- for conducting the meetings of the board. The meeting place may be a
197- private residence or office, provided that the board, in its order
192+ for conducting the meetings of the board. The meeting place may be

198194 establishing the meeting place, declares the same to be a public
199195 place and invites the public to attend any meeting of the board. If
200196 the board establishes a meeting place or places outside the
201197 district, it shall give notice of the location or locations by
202198 filing a true copy of the resolution establishing the location or
203199 locations of the meeting place or places and a justification of why
204200 the meeting will not be held in the district or within 10 miles of
205201 the boundary of the district, if applicable, with the commission
206202 and also by publishing notice of the location or locations in a
207203 newspaper of general circulation in the district. If the location
208204 of any of the meeting places outside the district is changed, notice
209205 of the change shall be given in the same manner.
210206 (b-1) In this subsection, "rural area district" means a
211207 district in which more than half of the district's projected retail
212208 water or sewer connections are active and that is not wholly or
213209 partly located in a county that as of the 2010 Census had a
214210 population of 800,000 or more or bordered a county with a population
215211 of 800,000 or more. If the board of a rural area district conducts
216212 meetings at least quarterly, the board shall conduct a meeting at a
217213 designated meeting location inside the district or within 10 miles
218214 of the boundary of the district at least once per quarter. If the
219215 board determines that it is not practical to meet within 10 miles of
220216 the boundary of the district, the district may conduct the
221217 quarterly meeting at another designated meeting place in the county
222218 in which the district is located.
223219 SECTION 5. Section 49.0631, Water Code, is amended to read
224220 as follows:
225221 Sec. 49.0631. DISTRICT [MEETING] INFORMATION ON WATER BILL.
226222 A district providing potable water or sewer service shall as a part
227223 of the district's billing process include on a district's bill to a
228224 customer the following statement: "For more information about the
229225 district, including information about the district's board and
230226 board meetings, please go to the Comptroller's Special Purpose
231227 District Public Information Database or (district's Internet
232228 website if the district maintains an Internet website, or, if the
233229 district does not maintain an Internet website, the Internet
234230 website or websites the district uses to comply with Section
235231 2051.202, Government Code, and Section 26.18, Tax Code)." The
236232 statement may be altered to provide the current Internet website
237233 address of [either] the database created under Section 403.0241,
238234 Government Code, [or] the district, or the Internet website or
239235 websites the district uses to comply with Section 2051.202,
240236 Government Code, and Section 26.18, Tax Code.
241237 SECTION 6. Sections 2051.202(d)(13) and (14), Government
242238 Code, as added by this Act, apply only to a meeting held by a special
243239 purpose district on or after the effective date of this Act.
244240 SECTION 7. To the extent of any conflict, this Act prevails
245241 over another Act of the 87th Legislature, Regular Session, 2021,
246242 relating to nonsubstantive additions to and corrections in enacted
247243 codes.
248244 SECTION 8. This Act takes effect September 1, 2021.
