57 relating to the service of a notice of assessment by the Texas
68 Workforce Commission under the Texas Unemployment Compensation
79 Act.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 213.032(a), Labor Code, is amended to
1012 read as follows:
1113 (a) A notice of assessment shall be served on a defaulting
1214 employer:
1315 (1) by personal delivery;
1416 (2) by registered or certified mail, return receipt
1517 requested, or similar common carrier method to the employer's
1618 address as shown by commission records; or
1719 (3) if an attempt to serve a notice of the assessment
1820 in a manner described by Subdivision (1) or (2) has been
1921 unsuccessful, in another manner that is reasonably calculated to
2022 give the employer notice of the assessment [in the manner provided
2123 by law for service of process on a defendant in a civil action in
2224 district court].
2325 SECTION 2. This Act takes effect September 1, 2021.
