8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 213.032(a), Labor Code, is amended to |
---|
10 | 12 | | read as follows: |

11 | 13 | | (a) A notice of assessment shall be served on a defaulting |
---|
12 | 14 | | employer: |
---|
13 | 15 | | (1) by personal delivery; |
---|
14 | 16 | | (2) by registered or certified mail, return receipt |
---|
15 | 17 | | requested, or similar common carrier method to the employer's |
---|
16 | 18 | | address as shown by commission records; or |
---|
17 | 19 | | (3) if an attempt to serve a notice of the assessment |
---|
18 | 20 | | in a manner described by Subdivision (1) or (2) has been |
---|
19 | 21 | | unsuccessful, in another manner that is reasonably calculated to |
---|
20 | 22 | | give the employer notice of the assessment [in the manner provided |
---|
21 | 23 | | by law for service of process on a defendant in a civil action in |
---|
22 | 24 | | district court]. |

23 | 25 | | SECTION 2. This Act takes effect September 1, 2021. |
