57 relating to the carrying or storage of a handgun by a school
68 marshal.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Sections 37.0811(c), (d), and (e), Education
911 Code, are amended to read as follows:
1012 (c) A school marshal appointed by the board of trustees of a
1113 school district or the governing body of an open-enrollment charter
1214 school may carry a concealed handgun or possess a handgun on the
1315 physical premises of a school, but only:
1416 (1) in the manner provided by written regulations
1517 adopted by the board of trustees or the governing body; and
1618 (2) at a specific school as specified by the board of
1719 trustees or governing body, as applicable.
1820 (d) Any written regulations adopted for purposes of
1921 Subsection (c) must provide that a school marshal may carry a
2022 concealed handgun on the school marshal's person or [as described
2123 by Subsection (c), except that if the primary duty of the school
2224 marshal involves regular, direct contact with students, the marshal
2325 may not carry a concealed handgun but may] possess the [a] handgun
2426 on the physical premises of a school in a locked and secured safe or
2527 other locked and secured location [within the marshal's immediate
2628 reach when conducting the marshal's primary duty]. The written
2729 regulations must also require that a handgun carried or possessed
2830 by [or within access of] a school marshal may be loaded only with
2931 frangible duty ammunition approved for that purpose by the Texas
3032 Commission on Law Enforcement.
3133 (e) A school marshal may use [access] a handgun the school
3234 marshal is authorized to carry or possess under this section only
3335 under circumstances that would justify the use of deadly force
3436 under Section 9.32 or 9.33, Penal Code.
3537 SECTION 2. Sections 37.0813(c), (d), and (e), Education
3638 Code, are amended to read as follows:
3739 (c) A school marshal appointed by the governing body of a
3840 private school may carry a concealed handgun or possess a handgun on
3941 the physical premises of a school, but only in the manner provided
4042 by written regulations adopted by the governing body.
4143 (d) Any written regulations adopted for purposes of
4244 Subsection (c) must provide that a school marshal may carry a
4345 concealed handgun on the school marshal's person or [as described
4446 by Subsection (c), except that if the primary duty of the school
4547 marshal involves regular, direct contact with students in a
4648 classroom setting, the marshal may not carry a concealed handgun
4749 but may] possess the [a] handgun on the physical premises of a
4850 school in a locked and secured safe or other locked and secured
4951 location [within the marshal's immediate reach when conducting the
5052 marshal's primary duty]. The written regulations must also require
5153 that a handgun carried or possessed by [or within access of] a
5254 school marshal may be loaded only with frangible duty ammunition
5355 approved for that purpose by the Texas Commission on Law
5456 Enforcement.
5557 (e) A school marshal may use [access] a handgun the school
5658 marshal is authorized to carry or possess under this section only
5759 under circumstances that would justify the use of deadly force
5860 under Section 9.32 or 9.33, Penal Code.
5961 SECTION 3. Sections 51.220(d), (e), and (f), Education
6062 Code, are amended to read as follows:
6163 (d) A school marshal appointed by the governing board of a
6264 public junior college may carry a concealed handgun or possess a
6365 handgun on the physical premises of a public junior college campus,
6466 but only:
6567 (1) in the manner provided by written regulations
6668 adopted by the governing board; and
6769 (2) at a specific public junior college campus as
6870 specified by the governing board.
6971 (e) Any written regulations adopted for purposes of
7072 Subsection (d) must provide that a school marshal may carry a
7173 concealed handgun on the school marshal's person or [as described
7274 by Subsection (d), except that if the primary duty of the school
7375 marshal involves regular, direct contact with students, the marshal
7476 may not carry a concealed handgun but may] possess the [a] handgun
7577 on the physical premises of a public junior college campus in a
7678 locked and secured safe or other locked and secured location
7779 [within the marshal's immediate reach when conducting the marshal's
7880 primary duty]. The written regulations must also require that a
7981 handgun carried or possessed by [or within access of] a school
8082 marshal may be loaded only with frangible duty ammunition approved
8183 for that purpose by the Texas Commission on Law Enforcement.
8284 (f) A school marshal may use [access] a handgun the school
8385 marshal is authorized to carry or possess under this section only
8486 under circumstances that would justify the use of deadly force
8587 under Section 9.32 or 9.33, Penal Code.
8688 SECTION 4. This Act applies beginning with the 2021-2022
8789 school year.
8890 SECTION 5. This Act takes effect immediately if it receives
8991 a vote of two-thirds of all the members elected to each house, as
9092 provided by Section 39, Article III, Texas Constitution. If this
9193 Act does not receive the vote necessary for immediate effect, this
9294 Act takes effect September 1, 2021.
