| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter E, Chapter 54, Education Code, is | |
| 12 | 12 | amended by adding Section 54.5042 to read as follows: | |
| 13 | 13 | Sec. 54.5042. LIMITATION ON AMOUNT OF FEE FOR LATE PAYMENT | |
| 14 | 14 | OF STUDENT HOUSING COSTS. The governing board of an institution of | |
| 15 | 15 | higher education may not charge a student a fee for late payment of | |
| 16 | 16 | student housing costs incurred by the student for a semester or term | |
| 17 | 17 | in an amount greater than five percent of the total student housing | |
| 18 | 18 | costs incurred by the student for that semester or term. | |
| 19 | 19 | SECTION 2. This Act applies beginning with fees for late | |
| 20 | 20 | payment of student housing costs charged for the 2021 fall | |
| 21 | 21 | semester. | |
| 22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2021. |
