 A BILL TO BE ENTITLED
 AN ACT
 relating to a limitation on the amount of a fee charged by a public
 institution of higher education for late payment of student housing
 costs.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter E, Chapter 54, Education Code, is
 amended by adding Section 54.5042 to read as follows:
 Sec. 54.5042.  LIMITATION ON AMOUNT OF FEE FOR LATE PAYMENT
 OF STUDENT HOUSING COSTS. The governing board of an institution of
 higher education may not charge a student a fee for late payment of
 student housing costs incurred by the student for a semester or term
 in an amount greater than five percent of the total student housing
 costs incurred by the student for that semester or term.
 SECTION 2.  This Act applies beginning with fees for late
 payment of student housing costs charged for the 2021 fall
 semester.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2021.
