46 AN ACT
57 relating to the authority of a municipality to add property to a
68 common characteristic public improvement district.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 372.0121, Local Government Code, is
911 amended to read as follows:
1012 Sec. 372.0121. INCLUSION OF PROPERTY [AREA] IN COMMON
1113 CHARACTERISTIC PUBLIC IMPROVEMENT DISTRICT. (a) Notwithstanding
1214 Section 372.012 or any other requirement in this chapter, the
1315 governing body of a municipality may include property in a public
1416 improvement district described by Section 372.0035 after the
1517 establishment of the district if:
1618 (1) the property is a hotel; and
1719 (2) a sufficient number of the record owners of the
1820 real property currently included and proposed to be included in the
1921 district have consented to be included in the district by signing
2022 the original petition to establish the district or by signing a
2123 petition or written consent to include property in the district
2224 [the property could have been included in the district without
2325 violating Section 372.005(b-1) when the district was created
2426 regardless of whether the record owners of the property signed the
2527 original petition].
26- (b) Notwithstanding Subsection (a), no newly constructed
27- hotel property may be added to the district unless the record owner
28- of the property consents to its inclusion.
29- (c) For purposes of Subsection (a)(2), the number of

3837 (2) own, in aggregate, more than 60 percent of the area
3938 of all taxable real property liable for assessment in the district.
4039 SECTION 2. This Act takes effect immediately if it receives
4140 a vote of two-thirds of all the members elected to each house, as
4241 provided by Section 39, Article III, Texas Constitution. If this
4342 Act does not receive the vote necessary for immediate effect, this
4443 Act takes effect September 1, 2021.
