7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 372.0121, Local Government Code, is |
---|
9 | 11 | | amended to read as follows: |
---|
10 | 12 | | Sec. 372.0121. INCLUSION OF PROPERTY [AREA] IN COMMON |
---|
11 | 13 | | CHARACTERISTIC PUBLIC IMPROVEMENT DISTRICT. (a) Notwithstanding |
---|
12 | 14 | | Section 372.012 or any other requirement in this chapter, the |
---|
13 | 15 | | governing body of a municipality may include property in a public |
---|
14 | 16 | | improvement district described by Section 372.0035 after the |
---|
15 | 17 | | establishment of the district if: |
---|
16 | 18 | | (1) the property is a hotel; and |
---|
17 | 19 | | (2) a sufficient number of the record owners of the |
---|
18 | 20 | | real property currently included and proposed to be included in the |
---|
19 | 21 | | district have consented to be included in the district by signing |
---|
20 | 22 | | the original petition to establish the district or by signing a |
---|
21 | 23 | | petition or written consent to include property in the district |
---|
22 | 24 | | [the property could have been included in the district without |
---|
23 | 25 | | violating Section 372.005(b-1) when the district was created |
---|
24 | 26 | | regardless of whether the record owners of the property signed the |
---|
25 | 27 | | original petition]. |
---|
30 | 29 | | consenting record owners is sufficient if the record owners own |
---|
31 | 30 | | more than 60 percent of appraised value of taxable real property |
---|
32 | 31 | | liable for assessment in the district, as determined by the current |
---|
33 | 32 | | appraisal roll of the appraisal district in which the property is |
---|
34 | 33 | | located, and: |
---|
35 | 34 | | (1) constitute more than 60 percent of all record |
---|
36 | 35 | | owners of taxable real property liable for assessment in the |
---|
37 | 36 | | district; or |
---|
38 | 37 | | (2) own, in aggregate, more than 60 percent of the area |
---|
39 | 38 | | of all taxable real property liable for assessment in the district. |
---|
40 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
---|
41 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 43 | | Act takes effect September 1, 2021. |
