8 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 8 | | SECTION 1. Section 38.001, Civil Practice and Remedies |
---|
10 | 9 | | Code, is amended to read as follows: |

11 | 10 | | Sec. 38.001. RECOVERY OF ATTORNEY'S FEES. A person may |
---|
12 | 11 | | recover reasonable attorney's fees from another person [an |
---|
13 | 12 | | individual or corporation], in addition to the amount of a valid |
---|
14 | 13 | | claim and costs, if the claim is for: |
---|
15 | 14 | | (1) rendered services; |
---|
16 | 15 | | (2) performed labor; |
---|
17 | 16 | | (3) furnished material; |
---|
18 | 17 | | (4) freight or express overcharges; |
---|
19 | 18 | | (5) lost or damaged freight or express; |
---|
20 | 19 | | (6) killed or injured stock; |
---|
21 | 20 | | (7) a sworn account; or |
---|
22 | 21 | | (8) an oral or written contract. |

23 | 22 | | SECTION 2. Section 38.001, Civil Practice and Remedies |

24 | 23 | | Code, as amended by this Act, applies only to an award of attorney's |
---|
25 | 24 | | fees in an action commenced on or after the effective date of this |
---|
26 | 25 | | Act. An award of attorney's fees in an action commenced before the |
---|
27 | 26 | | effective date of this Act is governed by the law applicable to the |
---|
28 | 27 | | award immediately before the effective date of this Act, and that |
---|
29 | 28 | | law is continued in effect for that purpose. |
---|
30 | 29 | | SECTION 3. This Act takes effect September 1, 2021. |
