87 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
98 SECTION 1. Section 38.001, Civil Practice and Remedies
109 Code, is amended to read as follows:
1110 Sec. 38.001. RECOVERY OF ATTORNEY'S FEES. A person may
1211 recover reasonable attorney's fees from another person [an
1312 individual or corporation], in addition to the amount of a valid
1413 claim and costs, if the claim is for:
1514 (1) rendered services;
1615 (2) performed labor;
1716 (3) furnished material;
1817 (4) freight or express overcharges;
1918 (5) lost or damaged freight or express;
2019 (6) killed or injured stock;
2120 (7) a sworn account; or
2221 (8) an oral or written contract.
2322 SECTION 2. Section 38.001, Civil Practice and Remedies
2423 Code, as amended by this Act, applies only to an award of attorney's
2524 fees in an action commenced on or after the effective date of this
2625 Act. An award of attorney's fees in an action commenced before the
2726 effective date of this Act is governed by the law applicable to the
2827 award immediately before the effective date of this Act, and that
2928 law is continued in effect for that purpose.
3029 SECTION 3. This Act takes effect September 1, 2021.
