511 A BILL TO BE ENTITLED
612 AN ACT
713 relating to the authorization by a school district or
814 open-enrollment charter school for a person to carry or possess a
915 weapon on school premises for purposes of safety and security.
1016 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1117 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1218 amended by adding Section 37.0814 to read as follows:
1319 Sec. 37.0814. SCHOOL GUARDIANS. (a) In this section,
1420 "school guardian" means a person who, pursuant to the written
1521 regulations or written authorization of a school district or
1622 open-enrollment charter school under Section 46.03(a)(1)(A), Penal
1723 Code, is authorized to carry or possess a specified weapon for the
1824 purpose of providing safety and security on the physical premises
1925 of a school, any grounds or building on which an activity sponsored
2026 by a school is being conducted, or a passenger transportation
2127 vehicle of a school.
2228 (b) The Texas School Safety Center shall develop best
2329 practices for school districts and open-enrollment charter schools
2430 that authorize school guardians to provide safety and security.
2531 (c) A school district or open-enrollment charter school
2632 that has adopted written regulations or written authorization
2733 allowing for school guardians shall report any information relating
2834 to the implementation of the regulations or authorization and the
2935 identity of each school guardian to:
3036 (1) the Texas School Safety Center, in the form and
3137 manner prescribed by the center; and
3238 (2) a state or local law enforcement agency, on
3339 written request of the head of the agency.
3440 (d) Information reported under Subsection (c) is
3541 confidential and is not subject to disclosure under Chapter 552,
3642 Government Code, by a school district, an open-enrollment charter
3743 school, the Texas School Safety Center, or a law enforcement
3844 agency.
3945 SECTION 2. This Act takes effect September 1, 2021.
