| 10 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 17 | | SECTION 1. Subchapter C, Chapter 37, Education Code, is |
|---|
| 12 | 18 | | amended by adding Section 37.0814 to read as follows: |
|---|
| 13 | 19 | | Sec. 37.0814. SCHOOL GUARDIANS. (a) In this section, |
|---|
| 14 | 20 | | "school guardian" means a person who, pursuant to the written |
|---|
| 15 | 21 | | regulations or written authorization of a school district or |
|---|
| 16 | 22 | | open-enrollment charter school under Section 46.03(a)(1)(A), Penal |
|---|
| 17 | 23 | | Code, is authorized to carry or possess a specified weapon for the |
|---|
| 18 | 24 | | purpose of providing safety and security on the physical premises |
|---|
| 19 | 25 | | of a school, any grounds or building on which an activity sponsored |
|---|
| 20 | 26 | | by a school is being conducted, or a passenger transportation |
|---|
| 21 | 27 | | vehicle of a school. |
|---|
| 22 | 28 | | (b) The Texas School Safety Center shall develop best |
|---|
| 23 | 29 | | practices for school districts and open-enrollment charter schools |
|---|
| 24 | 30 | | that authorize school guardians to provide safety and security. |
|---|
| 25 | 31 | | (c) A school district or open-enrollment charter school |
|---|
| 26 | 32 | | that has adopted written regulations or written authorization |
|---|
| 27 | 33 | | allowing for school guardians shall report any information relating |
|---|
| 28 | 34 | | to the implementation of the regulations or authorization and the |
|---|
| 29 | 35 | | identity of each school guardian to: |
|---|
| 30 | 36 | | (1) the Texas School Safety Center, in the form and |
|---|
| 31 | 37 | | manner prescribed by the center; and |
|---|
| 32 | 38 | | (2) a state or local law enforcement agency, on |
|---|
| 33 | 39 | | written request of the head of the agency. |
|---|
| 34 | 40 | | (d) Information reported under Subsection (c) is |
|---|
| 35 | 41 | | confidential and is not subject to disclosure under Chapter 552, |
|---|
| 36 | 42 | | Government Code, by a school district, an open-enrollment charter |
|---|
| 37 | 43 | | school, the Texas School Safety Center, or a law enforcement |
|---|
| 38 | 44 | | agency. |
|---|
| 39 | 45 | | SECTION 2. This Act takes effect September 1, 2021. |
