46 AN ACT
57 relating to the disclosure of information collected by a
68 metropolitan rapid transit authority, regional transportation
79 authority, municipal transit department, or coordinated county
810 transportation authority under the public information law.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 451.061, Transportation Code, is amended
1113 by amending Subsection (f) and adding Subsection (g) to read as
1214 follows:
1315 (f) Except as provided by Subsection (g), personal
1416 [Personal] identifying information collected by an authority is
1517 confidential and not subject to disclosure under Chapter 552,
1618 Government Code, including a person's:
1719 (1) name, address, e-mail address, and phone number;
1820 (2) account number, password, payment transaction
1921 activity, toll or charge record, or credit, debit, or other payment
2022 card number; [and]
2123 (3) trip data, including the time, date, origin, and
2224 destination of a trip, and demographic information collected when
2325 the person purchases a ticket or schedules a trip; and
2426 (4) other personal [financial] information, including
2527 financial information.
2628 (g) Personal identifying information described by
2729 Subsection (f)(3) may be disclosed to a governmental agency or
2830 institution of higher education, as defined by Section 61.003,
2931 Education Code, by an authority if the requestor confirms in
3032 writing that the use of the information will be strictly limited to
3133 use in research or in producing statistical reports, but only if the
3234 information is not published, redisclosed, sold, or used to contact
3335 any individual.
3436 SECTION 2. Section 452.061, Transportation Code, is amended
3537 by amending Subsection (e) and adding Subsection (f) to read as
3638 follows:
3739 (e) Except as provided by Subsection (f), personal
3840 [Personal] identifying information collected by an authority is
3941 confidential and not subject to disclosure under Chapter 552,
4042 Government Code, including a person's:
4143 (1) name, address, e-mail address, and phone number;
4244 (2) account number, password, payment transaction
4345 activity, toll or charge record, or credit, debit, or other payment
4446 card number; [and]
4547 (3) trip data, including the time, date, origin, and
4648 destination of a trip, and demographic information collected when
4749 the person purchases a ticket or schedules a trip; and
4850 (4) other personal [financial] information, including
4951 financial information.
5052 (f) Personal identifying information described by
5153 Subsection (e)(3) may be disclosed to a governmental agency or
5254 institution of higher education, as defined by Section 61.003,
5355 Education Code, by an authority if the requestor confirms in
5456 writing that the use of the information will be strictly limited to
5557 use in research or in producing statistical reports, but only if the
5658 information is not published, redisclosed, sold, or used to contact
5759 any individual.
5860 SECTION 3. Section 453.104, Transportation Code, is amended
5961 to read as follows:
6062 Sec. 453.104. FARES AND OTHER CHARGES. (a) The board
6163 shall, after a public hearing, impose reasonable and
6264 nondiscriminatory fares, tolls, charges, rents, or other
6365 compensation for the use of the transit department system
6466 sufficient to produce revenue, together with receipts from taxes
6567 imposed by the transit department, in an amount adequate to:
6668 (1) pay all the expenses necessary to operate and
6769 maintain the transit department system;
6870 (2) pay when due the principal of and interest on, and
6971 sinking fund and reserve fund payments agreed to be made with
7072 respect to, all bonds that are issued by the board and payable in
7173 whole or part from the revenue; and
7274 (3) fulfill the terms of any other agreement with the
7375 holders of bonds described by Subdivision (2) or with a person
7476 acting on behalf of the bondholders.
7577 (b) Except as provided by Subsection (c), personal
7678 identifying information collected by a transit department is
7779 confidential and not subject to disclosure under Chapter 552,
7880 Government Code, including a person's:
7981 (1) name, address, e-mail address, and phone number;
8082 (2) account number, password, payment transaction
8183 activity, toll or charge record, or credit, debit, or other payment
8284 card number;
8385 (3) trip data, including the time, date, origin, and
8486 destination of a trip, and demographic information collected when
8587 the person purchases a ticket or schedules a trip; and
8688 (4) other personal information, including financial
8789 information.
8890 (c) Personal identifying information described by
8991 Subsection (b)(3) may be disclosed to a governmental agency or
9092 institution of higher education, as defined by Section 61.003,
9193 Education Code, by a transit department if the requestor confirms
9294 in writing that the use of the information will be strictly limited
9395 to use in research or in producing statistical reports, but only if
9496 the information is not published, redisclosed, sold, or used to
9597 contact any individual.
9698 SECTION 4. Section 460.109, Transportation Code, is amended
9799 by amending Subsection (e) and adding Subsection (f) to read as
98100 follows:
99101 (e) Except as provided by Subsection (f), personal
100102 [Personal] identifying information collected by an authority is
101103 confidential and not subject to disclosure under Chapter 552,
102104 Government Code, including a person's:
103105 (1) name, address, e-mail address, and phone number;
104106 (2) account number, password, payment transaction
105107 activity, toll or charge record, or credit, debit, or other payment
106108 card number; [and]
107109 (3) trip data, including the time, date, origin, and
108110 destination of a trip, and demographic information collected when
109111 the person purchases a ticket or schedules a trip; and
110112 (4) other personal [financial] information, including
111113 financial information.
112114 (f) Personal identifying information described by
113115 Subsection (e)(3) may be disclosed to a governmental agency or
114116 institution of higher education, as defined by Section 61.003,
115117 Education Code, by an authority if the requestor confirms in
116118 writing that the use of the information will be strictly limited to
117119 use in research or in producing statistical reports, but only if the
118120 information is not published, redisclosed, sold, or used to contact
119121 any individual.
120122 SECTION 5. The changes in law made by this Act apply only to
121123 a request for information that is received by a regional
122124 transportation authority, metropolitan rapid transit authority,
123125 municipal transit department, or coordinated county transportation
124126 authority on or after the effective date of this Act. A request for
125127 information that was received before the effective date of this Act
126128 is governed by the law in effect on the date the request was
127129 received, and the former law is continued in effect for that
128130 purpose.
129131 SECTION 6. This Act takes effect immediately if it receives
130132 a vote of two-thirds of all the members elected to each house, as
131133 provided by Section 39, Article III, Texas Constitution. If this
132134 Act does not receive the vote necessary for immediate effect, this
133135 Act takes effect September 1, 2021.
