| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter A, Chapter 372, Transportation Code, | |
| 11 | 11 | is amended by adding Section 372.003 to read as follows: | |
| 12 | 12 | Sec. 372.003. ADJACENT NONTOLLED LANES REQUIRED. (a) The | |
| 13 | 13 | governing body of a toll project entity may not: | |
| 14 | 14 | (1) adopt a plan for the construction of a toll project | |
| 15 | 15 | unless the plan includes a plan for the construction of at least one | |
| 16 | 16 | adjacent nontolled lane of travel in each direction; or | |
| 17 | 17 | (2) authorize the collection of a toll for the use of a | |
| 18 | 18 | toll project in a plan described by Subdivision (1) until the | |
| 19 | 19 | planned nontolled lanes are open to traffic. | |
| 20 | 20 | (b) This section does apply to a department toll facility | |
| 21 | 21 | designation under Section 228.201(a)(3) or (4). | |
| 22 | 22 | SECTION 2. The change in law made by this Act applies only | |
| 23 | 23 | to a toll project for which an initial plan is adopted on or after | |
| 24 | 24 | September 1, 2021. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
