A BILL TO BE ENTITLED
AN ACT
relating to the inclusion in a toll project construction plan of a
plan for the construction of adjacent nontolled lanes.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 372, Transportation Code,
is amended by adding Section 372.003 to read as follows:
Sec. 372.003. ADJACENT NONTOLLED LANES REQUIRED. (a) The
governing body of a toll project entity may not:
(1) adopt a plan for the construction of a toll project
unless the plan includes a plan for the construction of at least one
adjacent nontolled lane of travel in each direction; or
(2) authorize the collection of a toll for the use of a
toll project in a plan described by Subdivision (1) until the
planned nontolled lanes are open to traffic.
(b) This section does apply to a department toll facility
designation under Section 228.201(a)(3) or (4).
SECTION 2. The change in law made by this Act applies only
to a toll project for which an initial plan is adopted on or after
September 1, 2021.
SECTION 3. This Act takes effect September 1, 2021.
