55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the model training curriculum and required education
88 and training of security personnel employed by a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.0812, Education Code, is amended to
1111 read as follows:
1212 Sec. 37.0812. TRAINING POLICY: SCHOOL DISTRICT PEACE
1313 OFFICERS, [AND] SCHOOL RESOURCE OFFICERS, AND SECURITY PERSONNEL.
1414 (a) A school district peace officer, [or] school resource officer,
1515 or person employed as security personnel shall complete an active
1616 shooter response training program approved by the Texas Commission
1717 on Law Enforcement.
1818 (b) A school district that commissions a school district
1919 peace officer or employs security personnel or at which a school
2020 resource officer provides law enforcement shall adopt a policy
2121 requiring the officer or security personnel to complete the
2222 education and training program required by Section 1701.263,
2323 Occupations Code.
2424 SECTION 2. The heading to Section 1701.262, Occupations
2525 Code, is amended to read as follows:
2626 Sec. 1701.262. TRAINING FOR SCHOOL DISTRICT PEACE OFFICERS,
2727 [AND] SCHOOL RESOURCE OFFICERS, AND SCHOOL SECURITY PERSONNEL.
2828 SECTION 3. Section 1701.262(a), Occupations Code, is
2929 amended by adding Subdivision (5) to read as follows:
3030 (5) "School security personnel" means a person
3131 employed as security personnel by the board of trustees of a school
3232 district under Section 37.081, Education Code.
3333 SECTION 4. Sections 1701.262(b) and (e), Occupations Code,
3434 are amended to read as follows:
3535 (b) The commission, in consultation with an institute or the
3636 center, shall create, adopt, and distribute a model training
3737 curriculum for school district peace officers, [and] school
3838 resource officers, and school security personnel.
3939 (e) The commission shall provide the curriculum developed
4040 under this section and any supplemental education materials created
4141 for the curriculum to:
4242 (1) school district police departments;
4343 (2) law enforcement agencies that place peace officers
4444 in a school as school resource officers under a memorandum of
4545 understanding; and
4646 (3) any entity that provides training to school
4747 district peace officers, [or] school resource officers, or school
4848 security personnel.
4949 SECTION 5. Section 1701.263, Occupations Code, is amended
5050 to read as follows:
5151 Sec. 1701.263. EDUCATION AND TRAINING PROGRAM FOR SCHOOL
5252 DISTRICT PEACE OFFICERS, [AND] SCHOOL RESOURCE OFFICERS, AND SCHOOL
5353 SECURITY PERSONNEL. (a) In this section:
5454 (1) "School district peace officer" and "school
5555 security personnel" have [has] the meanings [meaning] assigned by
5656 Section 1701.262.
5757 (2) "School resource officer" has the meaning assigned
5858 by Section 1701.601.
5959 (b) The commission by rule shall require a school district
6060 peace officer or a school resource officer who is commissioned by or
6161 who provides law enforcement at a school district or school
6262 security personnel at a school district to successfully complete an
6363 education and training program described by this section before or
6464 within 180 days of the officer's or person's commission by, [or]
6565 placement in, or employment at the district or a campus of the
6666 district. The program must:
6767 (1) consist of at least 16 hours of training;
6868 (2) be approved by the commission; and
6969 (3) provide training in accordance with the curriculum
7070 developed under Section 1701.262 in each subject area listed in
7171 Subsection (c) of that section.
7272 (b-1) Notwithstanding Subsection (b) or a rule adopted
7373 under that section, a school district peace officer, [or] school
7474 resource officer, or school security personnel is not required to
7575 successfully complete the education and training program required
7676 by this section if the officer or person has successfully completed
7777 the advanced training course conducted by the National Association
7878 of School Resource Officers or a training course equivalent to that
7979 advanced training course, as determined by the commission.
8080 (c) The education and training program required under this
8181 section may not require a peace officer or school security
8282 personnel to pass an examination, except that the commission shall
8383 administer an examination to qualify officers or security personnel
8484 to provide the education and training to other officers or security
8585 personnel. The examination to qualify an officer or person
8686 [officers] to provide the education and training must test the
8787 officer's or person's knowledge and recognition of the subject
8888 areas listed in Section 1701.262(c).
8989 (d) The commission shall issue a professional achievement
9090 or proficiency certificate to an [a peace] officer or person who
9191 completes the education and training program under this section.
9292 SECTION 6. As soon as practicable after the effective date
9393 of this Act and not later than December 1, 2021:
9494 (1) a school district that employs security personnel
9595 shall adopt a policy as required by Section 37.0812(b), Education
9696 Code, as amended by this Act; and
9797 (2) the Texas Commission on Law Enforcement shall
9898 amend the model training curriculum and rules as necessary to
9999 implement Sections 1701.262 and 1701.263, Occupations Code, as
100100 amended by this Act.
101101 SECTION 7. (a) As soon as practicable after the effective
102102 date of this Act but not later than August 31, 2022, a person
103103 employed as security personnel by a school district who begins
104104 employment on a date occurring before December 1, 2021, shall
105105 complete:
106106 (1) the training required by Section 37.0812,
107107 Education Code, as amended by this Act; and
108108 (2) the training required by Section 1701.263,
109109 Occupations Code, as amended by this Act.
110110 (b) Subsection (a) of this section does not apply to a
111111 person who is exempt from the training established under Section
112112 1701.263, Occupations Code, as amended by this Act, because the
113113 person has completed the training described by Subsection (b-1) of
114114 that section.
115115 SECTION 8. This Act takes effect September 1, 2021.
