6	6	AN ACT
7	7	relating to the model training curriculum and required education
8	8	and training of security personnel employed by a school district.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 37.0812, Education Code, is amended to
11	11	read as follows:
12	12	Sec. 37.0812. TRAINING POLICY: SCHOOL DISTRICT PEACE
13	13	OFFICERS, [AND] SCHOOL RESOURCE OFFICERS, AND SECURITY PERSONNEL.
14	14	(a) A school district peace officer, [or] school resource officer,
15	15	or person employed as security personnel shall complete an active
16	16	shooter response training program approved by the Texas Commission
17	17	on Law Enforcement.
18	18	(b) A school district that commissions a school district
19	19	peace officer or employs security personnel or at which a school
20	20	resource officer provides law enforcement shall adopt a policy
21	21	requiring the officer or security personnel to complete the
22	22	education and training program required by Section 1701.263,
23	23	Occupations Code.
24	24	SECTION 2. The heading to Section 1701.262, Occupations
25	25	Code, is amended to read as follows:
26	26	Sec. 1701.262. TRAINING FOR SCHOOL DISTRICT PEACE OFFICERS,
27	27	[AND] SCHOOL RESOURCE OFFICERS, AND SCHOOL SECURITY PERSONNEL.
28	28	SECTION 3. Section 1701.262(a), Occupations Code, is
29	29	amended by adding Subdivision (5) to read as follows:
30	30	(5) "School security personnel" means a person
31	31	employed as security personnel by the board of trustees of a school
32	32	district under Section 37.081, Education Code.
33	33	SECTION 4. Sections 1701.262(b) and (e), Occupations Code,
34	34	are amended to read as follows:
35	35	(b) The commission, in consultation with an institute or the
36	36	center, shall create, adopt, and distribute a model training
37	37	curriculum for school district peace officers, [and] school
38	38	resource officers, and school security personnel.
39	39	(e) The commission shall provide the curriculum developed
40	40	under this section and any supplemental education materials created
41	41	for the curriculum to:
42	42	(1) school district police departments;
43	43	(2) law enforcement agencies that place peace officers
44	44	in a school as school resource officers under a memorandum of
45	45	understanding; and
46	46	(3) any entity that provides training to school
47	47	district peace officers, [or] school resource officers, or school
48	48	security personnel.
49	49	SECTION 5. Section 1701.263, Occupations Code, is amended
50	50	to read as follows:
51	51	Sec. 1701.263. EDUCATION AND TRAINING PROGRAM FOR SCHOOL
52	52	DISTRICT PEACE OFFICERS, [AND] SCHOOL RESOURCE OFFICERS, AND SCHOOL
53	53	SECURITY PERSONNEL. (a) In this section:
54	54	(1) "School district peace officer" and "school
55	55	security personnel" have [has] the meanings [meaning] assigned by
56	56	Section 1701.262.
57	57	(2) "School resource officer" has the meaning assigned
58	58	by Section 1701.601.
59	59	(b) The commission by rule shall require a school district
60	60	peace officer or a school resource officer who is commissioned by or
61	61	who provides law enforcement at a school district or school
62	62	security personnel at a school district to successfully complete an
63	63	education and training program described by this section before or
64	64	within 180 days of the officer's or person's commission by, [or]
65	65	placement in, or employment at the district or a campus of the
66	66	district. The program must:
67	67	(1) consist of at least 16 hours of training;
68	68	(2) be approved by the commission; and
69	69	(3) provide training in accordance with the curriculum
70	70	developed under Section 1701.262 in each subject area listed in
71	71	Subsection (c) of that section.
72	72	(b-1) Notwithstanding Subsection (b) or a rule adopted
73	73	under that section, a school district peace officer, [or] school
74	74	resource officer, or school security personnel is not required to
75	75	successfully complete the education and training program required
76	76	by this section if the officer or person has successfully completed
77	77	the advanced training course conducted by the National Association
78	78	of School Resource Officers or a training course equivalent to that
79	79	advanced training course, as determined by the commission.
80	80	(c) The education and training program required under this
81	81	section may not require a peace officer or school security
82	82	personnel to pass an examination, except that the commission shall
83	83	administer an examination to qualify officers or security personnel
84	84	to provide the education and training to other officers or security
85	85	personnel. The examination to qualify an officer or person
86	86	[officers] to provide the education and training must test the
87	87	officer's or person's knowledge and recognition of the subject
88	88	areas listed in Section 1701.262(c).
89	89	(d) The commission shall issue a professional achievement
90	90	or proficiency certificate to an [a peace] officer or person who
91	91	completes the education and training program under this section.
92	92	SECTION 6. As soon as practicable after the effective date
93	93	of this Act and not later than December 1, 2021:
94	94	(1) a school district that employs security personnel
95	95	shall adopt a policy as required by Section 37.0812(b), Education
96	96	Code, as amended by this Act; and
97	97	(2) the Texas Commission on Law Enforcement shall
98	98	amend the model training curriculum and rules as necessary to
99	99	implement Sections 1701.262 and 1701.263, Occupations Code, as
100	100	amended by this Act.
101	101	SECTION 7. (a) As soon as practicable after the effective
102	102	date of this Act but not later than August 31, 2022, a person
103	103	employed as security personnel by a school district who begins
104	104	employment on a date occurring before December 1, 2021, shall
105	105	complete:
106	106	(1) the training required by Section 37.0812,
107	107	Education Code, as amended by this Act; and
108	108	(2) the training required by Section 1701.263,
109	109	Occupations Code, as amended by this Act.
110	110	(b) Subsection (a) of this section does not apply to a
111	111	person who is exempt from the training established under Section
112	112	1701.263, Occupations Code, as amended by this Act, because the
113	113	person has completed the training described by Subsection (b-1) of
114	114	that section.
115	115	SECTION 8. This Act takes effect September 1, 2021.
