4	6		AN ACT
5	7		relating to the enforcement of commercial motor vehicle safety
6	8		standards in certain counties.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Section 644.101(c), Transportation Code, as
9	11		amended by Chapters 169 (H.B. 917) and 478 (H.B. 511), Acts of the
10	12		86th Legislature, Regular Session, 2019, is reenacted and amended
11	13		to read as follows:
12	14		(c) A sheriff or a deputy sheriff of any of the following
13	15		counties is eligible to apply for certification under this section:
14	16		(1) a county bordering the United Mexican States;
15	17		(2) a county with a population of less than 1,000, part
16	18		of which is located within 75 miles of an international border; [or]
17	19		(3) [(2)] a county with a population of 700,000 or
18	20		more; [or]
19	21		(4) [(3)] a county with a population of 400,000 or
20	22		more that borders the county in which the State Capitol is located;
	23	+	or
21	24		(5) a county:
22	25		(A) any part of which is within 30 miles of New
23	26		Mexico; and
24	27		(B) that is adjacent to two or more counties that
25	28		generated $100 million or more in tax revenue collected under
26	29		Chapters 201 and 202, Tax Code, from oil and gas production during
27		-	the preceding state fiscal year; or
28		-	(6) a county with a population of more than 40,000 and
29		-	less than 300,000 that is adjacent to a county described by
30		-	Subdivision (4).
	30	+	the preceding state fiscal year.
31	31		SECTION 2. To the extent of any conflict, this Act prevails
32	32		over another Act of the 87th Legislature, Regular Session, 2021,
33	33		relating to nonsubstantive additions to and corrections in enacted
34	34		codes.
35	35		SECTION 3. This Act takes effect September 1, 2021.
