59 relating to the expiration and extension of certain public health
610 orders issued by a health authority.
711 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
812 SECTION 1. Subchapter B, Chapter 121, Health and Safety
913 Code, is amended by adding Section 121.026 to read as follows:
1014 Sec. 121.026. EXPIRATION AND EXTENSION OF CERTAIN PUBLIC
1115 HEALTH ORDERS ISSUED BY HEALTH AUTHORITY. (a) This section applies
1216 only to a public health order imposed on more than one individual,
1317 animal, place, or object.
1418 (b) A public health order issued by a health authority under
15- this chapter or other law expires on the 15th day following the date
16- the order is issued unless, before the 15th day by majority vote:
19+ this chapter or other law expires on the eighth day following the
20+ date the order is issued unless, before the eighth day by majority
21+ vote:
1722 (1) the governing body of a municipality or the
1823 commissioners court of a county that appointed the health authority
1924 extends the order for a longer period; or
2025 (2) if the health authority is jointly appointed by a
2126 municipality and county, the commissioner's court of the county
2227 extends the order for a longer period.
2328 SECTION 2. Section 121.026, Health and Safety Code, as
2429 added by this Act, applies only to a public health order issued by a
2530 health authority on or after the effective date of this Act. A
2631 public health order issued by a health authority before the
2732 effective date of this Act is governed by the law in effect when the
2833 public health order was issued, and the former law is continued in
2934 effect for that purpose.
3035 SECTION 3. This Act takes effect September 1, 2021.
