4	8		AN ACT
5	9		relating to the expiration and extension of certain public health
6	10		orders issued by a health authority.
7	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	12		SECTION 1. Subchapter B, Chapter 121, Health and Safety
9	13		Code, is amended by adding Section 121.026 to read as follows:
10	14		Sec. 121.026. EXPIRATION AND EXTENSION OF CERTAIN PUBLIC
11	15		HEALTH ORDERS ISSUED BY HEALTH AUTHORITY. (a) This section applies
12	16		only to a public health order imposed on more than one individual,
13	17		animal, place, or object.
14	18		(b) A public health order issued by a health authority under
15		-	this chapter or other law expires on the 15th day following the date
16		-	the order is issued unless, before the 15th day by majority vote:
	19	+	this chapter or other law expires on the eighth day following the
	20	+	date the order is issued unless, before the eighth day by majority
	21	+	vote:
17	22		(1) the governing body of a municipality or the
18	23		commissioners court of a county that appointed the health authority
19	24		extends the order for a longer period; or
20	25		(2) if the health authority is jointly appointed by a
21	26		municipality and county, the commissioner's court of the county
22	27		extends the order for a longer period.
23	28		SECTION 2. Section 121.026, Health and Safety Code, as
24	29		added by this Act, applies only to a public health order issued by a
25	30		health authority on or after the effective date of this Act. A
26	31		public health order issued by a health authority before the
27	32		effective date of this Act is governed by the law in effect when the
28	33		public health order was issued, and the former law is continued in
29	34		effect for that purpose.
30	35		SECTION 3. This Act takes effect September 1, 2021.
