55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring public school and public institution of
88 higher education students to compete in interscholastic athletic
99 competitions based on biological sex.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1212 amended by adding Section 33.0834 to read as follows:
1313 Sec. 33.0834. INTERSCHOLASTIC ATHLETIC COMPETITION BASED
1414 ON BIOLOGICAL SEX. (a) Except as provided by Subsection (b), an
1515 interscholastic athletic team sponsored or authorized by a school
1616 district or open-enrollment charter school may not allow a student
1717 to compete in an interscholastic athletic competition sponsored or
1818 authorized by the district or school that is designated for the
1919 biological sex opposite to the student's biological sex as
2020 correctly stated on:
2121 (1) the student's official birth certificate, as
2222 described by Subsection (c); or
2323 (2) if the student's official birth certificate
2424 described by Subdivision (1) is unobtainable, another government
2525 record.
2626 (b) An interscholastic athletic team described by
2727 Subsection (a) may allow a female student to compete in an
2828 interscholastic athletic competition that is designated for male
2929 students if a corresponding interscholastic athletic competition
3030 designated for female students is not offered or available.
3131 (c) For purposes of this section, a statement of a student's
3232 biological sex on the student's official birth certificate is
3333 considered to have correctly stated the student's biological sex
3434 only if the statement was:
3535 (1) entered at or near the time of the student's birth;
3636 or
3737 (2) modified to correct a clerical error in the
3838 student's biological sex.
3939 (d) The University Interscholastic League shall adopt rules
4040 to implement this section, provided that the rules must be approved
4141 by the commissioner in accordance with Section 33.083(b).
4242 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
4343 amended by adding Section 51.980 to read as follows:
4444 Sec. 51.980. INTERSCHOLASTIC ATHLETIC COMPETITION BASED ON
4545 BIOLOGICAL SEX. (a) In this section, "institution of higher
4646 education" has the meaning assigned by Section 61.003.
4747 (b) Except as provided by Subsection (c), an
4848 interscholastic athletic team sponsored or authorized by an
4949 institution of higher education may not allow a student to compete
5050 in an interscholastic athletic competition sponsored or authorized
5151 by the institution that is designated for the biological sex
5252 opposite to the student's biological sex as correctly stated on:
5353 (1) the student's official birth certificate, as
5454 described by Subsection (d); or
5555 (2) if the student's official birth certificate
5656 described by Subdivision (1) is unobtainable, another government
5757 record.
5858 (c) An interscholastic athletic team described by
5959 Subsection (b) may allow a female student to compete in an
6060 interscholastic athletic competition that is designated for male
6161 students if a corresponding interscholastic athletic competition
6262 designated for female students is not offered or available.
6363 (d) For purposes of this section, a statement of a student's
6464 biological sex on the student's official birth certificate is
6565 considered to have correctly stated the student's biological sex
6666 only if the statement was:
6767 (1) entered at or near the time of the student's birth;
6868 or
6969 (2) modified to correct a clerical error in the
7070 student's biological sex.
7171 SECTION 3. (a) Section 33.0834, Education Code, as added by
7272 this Act, applies beginning with the 2021-2022 school year.
7373 (b) Section 51.980, Education Code, as added by this Act,
7474 applies beginning with the 2021-2022 academic year.
7575 SECTION 4. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect on the 91st day after the last day of the
8080 legislative session.
