55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prohibition on the transportation, storage, and
88 disposal of high-level radioactive waste in certain areas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 401, Health and Safety
1111 Code, is amended by adding Section 401.072 to read as follows:
1212 Sec. 401.072. TRANSPORTATION, STORAGE, AND DISPOSAL OF
1313 HIGH-LEVEL RADIOACTIVE WASTE IN CRITICAL INFRASTRUCTURE ZONE. (a)
1414 In this section:
1515 (1) "Critical energy infrastructure zone" means an
1616 area designated by the commission under this section.
1717 (2) "High-level radioactive waste" has the meaning
1818 assigned by 42 U.S.C. Section 10101(12) and includes spent nuclear
1919 fuel as defined by 42 U.S.C. Section 10101(23).
2020 (b) A person may not import into, dispose of, or store
2121 high-level radioactive waste in an area of this state designated as
2222 a critical energy infrastructure zone.
2323 (c) The commission shall establish criteria and procedures
2424 for designating areas where oil and gas activities or other
2525 energy-related activities occur as critical energy infrastructure
2626 zones. In establishing the criteria and procedures, the commission
2727 shall consider establishing critical energy infrastructure zones
2828 in counties with more than:
2929 (1) 100 megawatts of installed solar energy generation
3030 capacity;
3131 (2) 100 megawatts of installed wind generation
3232 capacity;
3333 (3) 10,000,000 barrels of oil produced annually; or
3434 (4) 2,000,000 MCF of natural gas produced annually.
3535 (d) The designation of an area as a critical energy
3636 infrastructure zone remains in effect until the commission revokes
3737 the designation under procedures adopted by the commission.
3838 (e) The commission may amend the boundaries of a critical
3939 energy infrastructure zone.
4040 (f) The commission shall adopt rules necessary to implement
4141 this section.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect on the 91st day after the last day of the
4747 legislative session.
