| 8 | 8 | | disposal of high-level radioactive waste in certain areas. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 401, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 401.072 to read as follows: |
|---|
| 12 | 12 | | Sec. 401.072. TRANSPORTATION, STORAGE, AND DISPOSAL OF |
|---|
| 13 | 13 | | HIGH-LEVEL RADIOACTIVE WASTE IN CRITICAL INFRASTRUCTURE ZONE. (a) |
|---|
| 14 | 14 | | In this section: |
|---|
| 15 | 15 | | (1) "Critical energy infrastructure zone" means an |
|---|
| 16 | 16 | | area designated by the commission under this section. |
|---|
| 17 | 17 | | (2) "High-level radioactive waste" has the meaning |
|---|
| 18 | 18 | | assigned by 42 U.S.C. Section 10101(12) and includes spent nuclear |
|---|
| 19 | 19 | | fuel as defined by 42 U.S.C. Section 10101(23). |
|---|
| 20 | 20 | | (b) A person may not import into, dispose of, or store |
|---|
| 21 | 21 | | high-level radioactive waste in an area of this state designated as |
|---|
| 22 | 22 | | a critical energy infrastructure zone. |
|---|
| 23 | 23 | | (c) The commission shall establish criteria and procedures |
|---|
| 24 | 24 | | for designating areas where oil and gas activities or other |
|---|
| 25 | 25 | | energy-related activities occur as critical energy infrastructure |
|---|
| 26 | 26 | | zones. In establishing the criteria and procedures, the commission |
|---|
| 27 | 27 | | shall consider establishing critical energy infrastructure zones |
|---|
| 28 | 28 | | in counties with more than: |
|---|
| 29 | 29 | | (1) 100 megawatts of installed solar energy generation |
|---|
| 30 | 30 | | capacity; |
|---|
| 31 | 31 | | (2) 100 megawatts of installed wind generation |
|---|
| 32 | 32 | | capacity; |
|---|
| 33 | 33 | | (3) 10,000,000 barrels of oil produced annually; or |
|---|
| 34 | 34 | | (4) 2,000,000 MCF of natural gas produced annually. |
|---|
| 35 | 35 | | (d) The designation of an area as a critical energy |
|---|
| 36 | 36 | | infrastructure zone remains in effect until the commission revokes |
|---|
| 37 | 37 | | the designation under procedures adopted by the commission. |
|---|
| 38 | 38 | | (e) The commission may amend the boundaries of a critical |
|---|
| 39 | 39 | | energy infrastructure zone. |
|---|
| 40 | 40 | | (f) The commission shall adopt rules necessary to implement |
|---|
| 41 | 41 | | this section. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect on the 91st day after the last day of the |
|---|
| 47 | 47 | | legislative session. |
