| 7 | 7 | | relating to a voting system requirement that a person voting by |
|---|
| 8 | 8 | | personal appearance confirm the voter's eligibility to vote before |
|---|
| 9 | 9 | | accessing a ballot. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Subchapter A, Chapter 122, Election Code, is |
|---|
| 12 | 12 | | amended by adding Section 122.0015 to read as follows: |
|---|
| 13 | 13 | | Sec. 122.0015. VOTING SYSTEM STANDARDS: CONFIRMATION OF |
|---|
| 14 | 14 | | ELIGIBILITY. (a) A voting system may not be used in an election |
|---|
| 15 | 15 | | unless the voting system requires a person seeking to vote by |
|---|
| 16 | 16 | | personal appearance, before the person may access the ballot, to |
|---|
| 17 | 17 | | confirm that the person: |
|---|
| 18 | 18 | | (1) is a United States citizen; |
|---|
| 19 | 19 | | (2) is a resident of the county in which the person |
|---|
| 20 | 20 | | seeks to vote; |
|---|
| 21 | 21 | | (3) has not been determined by a final judgment of a |
|---|
| 22 | 22 | | court exercising probate jurisdiction to be: |
|---|
| 23 | 23 | | (A) totally mentally incapacitated; or |
|---|
| 24 | 24 | | (B) partially mentally incapacitated without the |
|---|
| 25 | 25 | | right to vote; and |
|---|
| 26 | 26 | | (4) has not been finally convicted of a felony or, if |
|---|
| 27 | 27 | | so convicted, has: |
|---|
| 28 | 28 | | (A) fully discharged the person's sentence, |
|---|
| 29 | 29 | | including any term of incarceration, parole, or supervision, or |
|---|
| 30 | 30 | | completed a period of probation ordered by any court; or |
|---|
| 31 | 31 | | (B) been pardoned or otherwise released from the |
|---|
| 32 | 32 | | resulting disability to vote. |
|---|
| 33 | 33 | | (b) The confirmation required under Subsection (a) may be |
|---|
| 34 | 34 | | completed by the person seeking to vote in one motion or gesture. |
|---|
| 35 | 35 | | (c) A person seeking to vote may request assistance from an |
|---|
| 36 | 36 | | election officer if the person: |
|---|
| 37 | 37 | | (1) has questions about the confirmation; or |
|---|
| 38 | 38 | | (2) determines that the person is unable to complete |
|---|
| 39 | 39 | | the confirmation. |
|---|
| 40 | 40 | | (d) The secretary of state shall adopt rules to implement |
|---|
| 41 | 41 | | this section. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect on the 91st day after the last day of the |
|---|
| 47 | 47 | | legislative session. |
