55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a voting system requirement that a person voting by
88 personal appearance confirm the voter's eligibility to vote before
99 accessing a ballot.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 122, Election Code, is
1212 amended by adding Section 122.0015 to read as follows:
1313 Sec. 122.0015. VOTING SYSTEM STANDARDS: CONFIRMATION OF
1414 ELIGIBILITY. (a) A voting system may not be used in an election
1515 unless the voting system requires a person seeking to vote by
1616 personal appearance, before the person may access the ballot, to
1717 confirm that the person:
1818 (1) is a United States citizen;
1919 (2) is a resident of the county in which the person
2020 seeks to vote;
2121 (3) has not been determined by a final judgment of a
2222 court exercising probate jurisdiction to be:
2323 (A) totally mentally incapacitated; or
2424 (B) partially mentally incapacitated without the
2525 right to vote; and
2626 (4) has not been finally convicted of a felony or, if
2727 so convicted, has:
2828 (A) fully discharged the person's sentence,
2929 including any term of incarceration, parole, or supervision, or
3030 completed a period of probation ordered by any court; or
3131 (B) been pardoned or otherwise released from the
3232 resulting disability to vote.
3333 (b) The confirmation required under Subsection (a) may be
3434 completed by the person seeking to vote in one motion or gesture.
3535 (c) A person seeking to vote may request assistance from an
3636 election officer if the person:
3737 (1) has questions about the confirmation; or
3838 (2) determines that the person is unable to complete
3939 the confirmation.
4040 (d) The secretary of state shall adopt rules to implement
4141 this section.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect on the 91st day after the last day of the
4747 legislative session.
