 A BILL TO BE ENTITLED
 AN ACT
 relating to a voting system requirement that a person voting by
 personal appearance confirm the voter's eligibility to vote before
 accessing a ballot.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter A, Chapter 122, Election Code, is
 amended by adding Section 122.0015 to read as follows:
 Sec. 122.0015.  VOTING SYSTEM STANDARDS: CONFIRMATION OF
 ELIGIBILITY. (a) A voting system may not be used in an election
 unless the voting system requires a person seeking to vote by
 personal appearance, before the person may access the ballot, to
 confirm that the person:
 (1)  is a United States citizen;
 (2)  is a resident of the county in which the person
 seeks to vote;
 (3)  has not been determined by a final judgment of a
 court exercising probate jurisdiction to be:
 (A)  totally mentally incapacitated; or
 (B)  partially mentally incapacitated without the
 right to vote; and
 (4)  has not been finally convicted of a felony or, if
 so convicted, has:
 (A)  fully discharged the person's sentence,
 including any term of incarceration, parole, or supervision, or
 completed a period of probation ordered by any court; or
 (B)  been pardoned or otherwise released from the
 resulting disability to vote.
 (b)  The confirmation required under Subsection (a) may be
 completed by the person seeking to vote in one motion or gesture.
 (c)  A person seeking to vote may request assistance from an
 election officer if the person:
 (1)  has questions about the confirmation; or
 (2)  determines that the person is unable to complete
 the confirmation.
 (d)  The secretary of state shall adopt rules to implement
 this section.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect on the 91st day after the last day of the
 legislative session.
