55 AN ACT
66 relating to a forensic audit of 2020 election results in certain
77 counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 16, Election Code, is amended by adding
1010 Chapter 280 to read as follows:
1111 CHAPTER 280. FORENSIC AUDIT OF 2020 GENERAL ELECTION
1212 Sec. 280.001. FORENSIC AUDIT OF 2020 GENERAL ELECTION. (a)
1313 The Secretary of State and Attorney General shall conduct a joint
1414 forensic audit of the general election that took place on November
1515 3, 2020.
1616 (b) The joint forensic audit conducted under Subsection (a)
1717 shall audit every precinct in each county where there is a
1818 discrepancy between the total number of votes counted and voters
1919 counted as having voted.
2020 (c) The audit under this section must begin not later than
2121 November 1, 2021, and be completed not later than February 1, 2022.
2222 (d) Not later than March 1, 2022, the results of the audit
2323 shall be submitted to the governor, lieutenant governor, speaker of
2424 the house of representatives, and each member of the legislature
2525 detailing any anomalies or discrepancies in voter data, ballot
2626 data, or tabulation.
2727 (e) This chapter expires April 1, 2022.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect on the 91st day after the last day of the
3333 legislative session.
