55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to affirmative defenses to prosecution for certain
88 offenses involving material or conduct that is obscene or otherwise
99 harmful to children.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.24(c), Penal Code, is amended to read
1212 as follows:
1313 (c) It is an affirmative defense to prosecution under this
1414 section that the sale, distribution, or exhibition was by a person
1515 having a bona fide judicial, law enforcement, or legislative
1616 [scientific, educational, governmental, or other similar]
1717 justification.
1818 SECTION 2. Section 43.25(f), Penal Code, is amended to read
1919 as follows:
2020 (f) It is an affirmative defense to a prosecution under this
2121 section that:
2222 (1) the defendant was the spouse of the child at the
2323 time of the offense;
2424 (2) the conduct was for a bona fide [educational,
2525 medical, psychological, psychiatric,] judicial, law enforcement,
2626 or legislative purpose; or
2727 (3) the defendant is not more than two years older than
2828 the child.
2929 SECTION 3. The changes in law made by this Act apply only to
3030 an offense committed on or after the effective date of this Act. An
3131 offense committed before the effective date of this Act is governed
3232 by the law in effect on the date the offense was committed, and the
3333 former law is continued in effect for that purpose. For purposes of
3434 this section, an offense was committed before the effective date of
3535 this Act if any element of the offense occurred before that date.
3636 SECTION 4. This Act takes effect September 1, 2023.
